So Jimmie is saying that you have already paid $900 on a $300 loan? What state are you in? I would demand a refund from Nationwide Cash and file a complaint with your AG's office.

I received a call and email from a Liz yesterday from Nationwide cash Recovery dept. The email stated they will settle my loan for $240.00 or if i don't respond they are sending me to their legal dept. These loans are prohibited in my state and I guess they don't want to follow US Laws. Any advice, since they won't give me a pif. I already filed complaints with the BBB and AG's Office, but no response from them yet.

Its funny I landed here because of Mr. "Mitchell" at Nationwide and his threats. I have never heard from them or OCC since late June even though I have sent them a DV and follow up letter, I don't like silence

I am in Ohio and yes I filed a complaint with the ag's office here and also with the FTC. In my e-mail to Jimmie - I told him I was also going to call all of the major tv networks - you know 20/20; Dateline; 48 hours. etc., even Americas Most Wanted. It didn't help - they still hit my account!

I used to get harrased by MR. Mitchell too. I guess he has given up on me and now sending me to someone else. I guess i am going to email this Liz person and tell her the same thing i told mr mitchell. They got enough and it's a lost cause for them to continue calling me because they have gotten enough.

Traci, Just sit tight and wait on the Attorney General. They came thru the other day for another person. Also make sure to not give new account info to anyone. KYSIDE38

i dealt with these people and last time i heard from them (dave) said the manager was reviewing my case and then last friday they hit my account 8 times for a total of $365.00.
i had just "closed my account on thursday after it was more then 800 overdrawn, so now i have a negative balance of $450.00 due to this idiots.
B of A paid five of the transactions even after i told them i did not authorize them...so i was told by b of a i will not be responsible for any of those fees but i'm skeptical they havent been really helpful.
the best thing to do is harass them and email them as many times as you can, to all the emails you have and the customer service email. thats how i stop them form calling me, and i was even told not to call them anymore.
keep up the fight!!!! :D :D

I was just on the web site for New Mexico's ag. I am going to call the 1800 number and register a formal compaint with them. I think that if I read their law on lending correctly 12.2.108 section K, that nationwides practices could be illegal there also. I am calling as soon as I get a break here.

I just received an e-mail from the reference desk for the state of New Mexico - this is very interesting:
Quote:
Your question has come to the reference desk at the New Mexico State Library. New Mexico has no laws regulating payday loans at this time, although the AGO has submitted regulations that are pending because of a lawsuit. The Consumer Protection Division of the New Mexico Attorney General????????s Office has a website at http://www.ago.state.nm.us/protectcons/protectcons.htm . The link to warnings and information about predatory loans is http://www.ago.state.nm.us/divs/cons/loans/cons_loans.htm . Information about the pending regulations on predatory loan practices is at this link: http://www.ago.state.nm.us/divs/cons/small_loan_ruels_regs/proposed_small_loan_rules_and_regulations.htm . I tried to call the Consumer Protection Division to find out more about the status of the new regulations, but I could not get a response. You should probably go ahead and file a consumer complaint even if you haven????????t been able to reach the phone numbers below: (800) 678-1508 (In-State Toll Free) (505) 827-6060 (Santa Fe) Fax: (505) 827-6685 Albuquerque: (505) 222-9000 |

And to add the cherry on the sundae, my cell phone rang yesterday--and it was someone from Nationwide asking if I still wanted a loan with them?? Huh??????? I told them no in record time, but started thinking that perhaps they're getting a little desparate?? It was amusing!

I have lots of problems with nationwide too..they told me not to e-mail them anymore and they were going to send me to collections..I paid them their money $360.00 on a $300.00 loan..Lynne said she didn't care that I filed complaints against them with the NM AG and the FL AG, but she also said:
Let me remind you that the loan contract you signed was very specific. This loan is subject to New Mexico law - not the laws of your state. If you wanted a loan subject to your state????????s laws, you should have borrowed from a lender in your state. Nationwide is a New Mexico lender.
We operate from offices in Espa????ola, New Mexico, where we are licensed to under New Mexico????????s Small Loan Act of 1955. Our regulator is the Financial Institutions Division of the New Mexico Regulation and Licensing Department, which conducts annual onsite audits. In contrast, we have no employees, agents, facilities or accounts in your state. In fact, our only connection with your state is that you live there. Simply, we do not fall under your state????????s jurisdiction.
According to our lawyers, even if the choice-of-law clause in the loan agreement wasn????????t valid, these are still New Mexico loans. This is because all of the critical elements that comprise a loan transactions - domicile of at least one party, analysis of the application, the final act necessary for contract formation, disbursement and repayment - all occur in New Mexico.
We would not have made you a loan if we were not 100% certain it was legal and enforceable. We have a valid claim against you and we are not going to simply go away. I strongly suggest you quit playing games and start resolving this matter now.

Again with this, this is not a Florida payday loan contract. I am getting really tired of this. I am not going to repeat myself again. We are not a Florida lender and this loan is governed by the state of New Mexico. Do not send me anymore literature on Florida lending laws because they have no bearance. You still have a balance and unless you plan on sleeping with your money under your mattress the ACH authorization agreement you signed states that any bank account you use or have control off we can debit. I don't want to have to take your money when your are sleeping because we can obtain your new bank account information. I am giving you the chance to resolve this matter voluntarily. What do you plan to do to resolve your account balance with us?

Wahsred - I got that same song and dance, but since the ag in New Mexico doesn't have and e-mail address I printed out the compaint form an I will be attaching all of the e-mails that I have sent and received (including the transcripts from the live chat) and I am going to faz them to the ag's office. My question to all of the ag's that I have been sending complaints to is this - If this company in your state is flaunting the laws of other states, what are they doing with the laws that you are supposed to be enforcing?

How did they debit after it was closed? I would think 8x in one day constitutes harrassment. They obviously know the money's not there, so they're trying to rack up the NSF fees to get even.

I know just how you feel - my bank will not close my account for the same reason - they said that by the time that they close the account 10 more debits could come in and I would still be overdrawn. I haven't had money in 3 weeks. And I am so overdrawn right now even my Christmas bonus is gone. I have no one to blame but myself for being so stupid!

I think that your bank is being totally unreasonable! If you tell them you don't authorize this company to debit you anymore and they do it anyway, then you are not liable! You have told them you don't authorize this and they allow it anyway? That's crazy! You should really make a stink here.

I also am problems with nationwide. Correct me if i am wrong. They stated they make sure they are 100% legit before lending out money. If that is true how come they are lending to people in states that are prohibited. Don't you have to have a license in that state to lend. So how legit is that?

I am so tied of these people thinking that they are above the law in all states but their own. I thought that this was against the some federal law. How can we gert them by using their own logic?

irish51cc, we are fighting these people each day and winning the war. If you go back to the beginning of this forum you will see that the victims of these companies are coming out from hiding. This site and other sites will grow in the next couple of years and the government will take notice and realize that all this is is legalized loan sharking and in some places its not legal. So all these companies can sit and laugh and think how they have dupped the public but I GUARANTEE you in the next few years we will see the corrupt start going down and this industry SHUT DOWN!

Thanks Ashley - I needed that! You know when I was a girl I was an anti war activist. I am beginning to think of this in the same manner. We are not stupid people who got caught up in this web, we just people who found ouselves in a financial bind and forgot the rule - if it looks to good to be true - it is. I sat down today and e-mailed Dateline. I gave them a short sceneario of what I (and all of us on this forum) are facing with these vipers. I am going to contact 48 hours and 20/20. I am sure that others have done this also, but maybe more of us should until someone takes us seriously.

There a lot of people on this board - none of whom are lawyers - that claim that lenders have to follow the laws of the borrowers' states. And there are lot of other people - most of whom are payday lenders - that claim the opposite.
The fact is that no one knows for sure because no court has ever made the decision one way or the other. But there are cases pending right now in federal courts in California and Kansas that may settle the issue once and for all.
Stay tuned.

Well an odd thing happened today with Natinwide - I went online AGAIN to "chat" with a customer service rep when I explained that I dod not have a reply from "jimmie" as I was supposed to. she said tha ther supervisor would be in on Monday. Well in the course of the conversation I mentioned that I had been in contact with the ag's office in New Mexico and they were very interesed in the correspondance that I had with Nationside. The next thing I new - low and behold didn't a supervisor come on line! The next thing that I new it was all a mistake - the supervisor got off line and I got the broom!
If you think of it Irish if you ever go back into chat with them
If you think of it Irish if you ever go back into chat with them don't close the chat window when the conversation is done, copy the chat transcript and you can use it if need be for evidence

Some banks offer a complete ACH block for their accounts. You guys should try that (ask your bank). That would prevent any ACH transactions from occuring. THat also means you can never set up automatic payments like car payments or insurance. But, you would know that these parasites can't come in and just dip their grubby hands into your bank account, even if they change their name.

You mean you can block ALL ACH's, and then your bank couldn't make money by charging a thousand NSF fees ... unheard of!
Actually, my company's checking account has a block on all electronic transactions. We put that in place after one of our customers started paying all her bills by making phone payments using our account #.
I just didn't think the banks did that for personal accounts.

My bank (National City) did the same thing, Irish, as far as not letting my account close. They said there had to be 30 days of no activity before they could close it. Of course, during that 30-day period, many wtihdrawals were attempted by different PDLs. Since there were blocks, even though the PDLs didn't get their money, the bank racked up their money. What started out as a 0 balance (when I "closed" my account) ended up finally being a -$613.00 balance. Isn't it amazing what banks can do with "your" account?

I tried to reason with my bank,(USBank) but they said that I authorized the transactions and there is nothing that they will do to help. as of this morning I am at -2500+ and have no way or means of paying this. I am getting a paper check today but i have to find somewhere to cash it. I am bereft!

irish, i'm sorry to hear that your bank is doing that, for a while my bank (b of A) told me they could not do anthing they left my acount open for over two months and i racked up 800+ in NSF, i finally decided to go to a branch to see if they can help me and i found this really great general manager that reduced my debt to 270 and said make the balance $0, and he did; unfortunately that was on a thursday and the very next day nationwide hit my account 8 times for a total of 350 and that reopen the account, the bank paid for 5 of the debits, i put in a claim and in less than a week my balance was a zero again so i called and finally had it closed.
there is something the banks can do, however they need to make money so the reps over the phone will tell you they cannot do anything to help you, go to the bank and pray and hope you get a very understanding person that will help you once you explain your situation to them, i pour my heart out to this guy at b of a and at first he said there is nothing the bank can do but i must of had and impression on him that he finally decided to do something.
keep trying go to the branch and if that person cannot help you, go to another branch you will be surprise what different people will tell you the bank can and cannot do...it is all about money.
good luck and keep us posted on your outcome.

One day I believe we will see legistlation in place that will address recurring ACH authorizations.
Just like a wage assignment is voluntary and you can revoke, same should apply to an ACH authorization. They should not be allowed to hold you to it until the day you die.

LOL lets hope, i asked one rep at point b of a will close the account? she had the nerves to tell me they keep the account open i guess forever or like you said until i die. thanks to the people and the forums i finally made it to the branch, because if i would listen to the reps over the phone i will be up to my $2000+ on nfs fees
NationWide Cash Harrasment
Are you kidding me!!!
When I first dealt with these people, specifically, Lynn Kennard, she threatened me. Just to give you an update, I travel for work alot so I am not in the office 80% of the time. This woman was trying to reach me and could not since I was away so she proceeded to start faxing my office over and over again with the word "Fraud" and threatening to contact my company to report me. Little did she know that I am not ignorant to this type of behavior. Not only is this considered harrasment but it is also illegal. When I called her to try and settle things in a humane manner, she put me on hold and gave me her boss, or so she said it was her boss and that is were the real big deal started. I offered to pay off exactly what I had borrowed which was $300 and this guy went off on me... he wanted the $300 plus $130 for a returned check plus another fee, I cannot even remember, which in all amounted to $510. Come on now???????.. let????????s be real. This guys insisted in speaking to me in an extremely loud voice and threatening. I explained that for the beginning of the month it was simply not possible since I had to pay rent. His exact words to my explanation were "I could care less if you have to pay rent or not".... This my friends is EXTREMELY illegal. I used to work in payroll for many years and even when any company reports you, if you cannot make living expenses you are not obligated to pay them, NO MATTER WHAT. So legally they cannot do anything regardless of what they say.
Yep
well i am going to start working nationwide now..they hammered me for 500 bucks and obtained my account number from some other loan my wife put in for then debited it. Even in the agreement thing, i believe it specified an account number which was different. But i reported them to my AG, and throught the Armys Judge Advocate General in Washington DC, anbd the DOD. These folks are annoying
