Hey Guys I have a question? Can Wells Fargo repossess a house if payments are 34 days late? I got the biggest butt-head on the phone today. Told me to cut down on food and to also cut my TV off and phone off and I could pay them. I hate these people beyond hate. KYSIDE38


Oh my goodness! Kyside, what an awful person you must have had on the phones. Sometimes these people are SO hateful.

From what I understand, it takes a LONG time to get a foreclosure done - from start to finish, it can take months. Are you in a position to be able to catch up soon? 34 days is such a small amount past due, I think they may be threatening you just to get the payment in, rather than actually planning on going through with it. Did they actually SAY they would foreclose?

I know Wells Fargo will do anything to collect the money. They will make all kinds of threats and insist legal actions if you are unable to do the payments.

Are you able to work out any payment plan with them? If you are not closer to your payment proposal, involve a debt counselor.

I am so sick of these people. Thats what they said I would be in default and they would start foreclosure. I regret the day I ever got them.If this was my local bank they would not have said such a thing. KYSIDE38

I always thought you had to be 3 payments behind, at least that is what is seems to be with the people I know. Wells Fargo people are pretty dumb, I had them call ME and offer to help me out of my financial problems, after someone at LVNV told them I needed help!! I said, I don't even know who you are, and by the way, how do you know of my fiancial problems!!..Karen

Guys I offered to do a check today for Jan 4 they have always wanted me to do that before. Not today. Its going to be paid Jan 4 but they said they could not take it and would call me 5 times or ten times a day if they wanted to. The reason this happened my husbands check got messed up with the direct deposit. KYSIDE38

KYSIDE38 - I went through a foreclosure procedure and they didn't start til we were 3 months behind, then it took 6 more months by time the court hearings, they have to send you a registered letter then you have cure time and after that cure time then they serve papers, you have 20 days from there to rebuttal, then a court date is set up..etc

Kyside - check your contract - youare trying to make a good faith payment, but I would get a certified bank check, or if your bank has bill pay have it sent though them. As for the phone attitude I would let the calls go into vm or answering machine and for every call I would call them back and ask for the supervisor.

Kyside - I was informed that there are cases where people stay in their house for a year or more before the foreclosure actually comes to pass - there are so many things that have to be done beforehand by the company, that it takes that long.

Your best bet, though is to do as advised above - send your payment in - chances are they won't send it back to you, because they most likely won't start foreclosure until you are much further behind.

My brother used to work for Wells Fargo. They used to get extra bonuses and rewards if they were able to keep the delinquency down. They could get an individual bonus based on their own accounts; and the whole office could get one big bonus if they beat out other offices.

He said they would look at all accounts over 30 days past-due, on the last day of the month. So they used to be in a rush to get the accounts over 30 to pay before the month was over. In this case, there is probably a "year end" bonus too, and they want to get you off the list before the year is over.

So they are just saying that to get their bonus. They're not going to go through all the paperwork to start a foreclosure when it is only 34 days late.

Kyside, what creeps to pull something like that right before Christmas! I agree, though. A friend of mine lost his job and went through a divorce at the same time so obviously couldn't pay on the house. Also, he's in his late 50s (he worked at LTV Steel), didn't really have many job skills, so ended up taking a job as a security officer. Also, his accounts were frozen until the divorce was finalized, so he couldn't make payments on his house. I think he was about 8 or 9 months behind before they foreclosed on his house. I really don't think they have much of a leg to stand on, especially since you said you'd make a payment on the 4th. If you can block their calls until after the holidays, you'd at least have some peace.

Kyside, I don't have wells fargo, although the mortgage co i have called me and just so happend i had pnuemonia at the time so i could barely talk. He wanted to know why my pymt was 3 days late. I went to explain i am unemployed and only get unemployment every 2wks so i am working around that. He had the nerve to ask do i go on interviews, has anyone tried to hire me and if so why did i not take it and are you really looking for a job. Then he went on to give me a number for a staffing company in my area. I was so upset that he had the nerve, i ended up telling him i will pay when i can in 2 wks and who the H*ll are you to ask about my job experiences.

i am 6 months late, they sent me a letter stating they had forward me to legal arbritration (I believe) i had been trying to work with them in telling them i could only afford a 300.00 monthly payment, they would not take it, said I needed to pay a full month back before they could work with me. when i stopped paying my payments where 799.99

You are paying 10.9 interest on a mortgage? Wow! No wonder you are having trouble making the payment. That is a high interest rate! I would be mad at them just for that reason. I was several days late with Wells Fargo on a conventional mortgage and never got phone calls like the ones you describe. I remember I used to get calls from Wells Fargo Financial when I was late a few days with a personal loan. But, that was a while ago.
