credit card people calling your work

Hi, and welcome to the forums :D As part of the fdcpa, debt collectors may not contact you at work if they know your employer disapproves.

what can you do if they continue to call you at work?

Once you inform them that your employer does not allow personal calls at work, they have to stop. If they don't, you have every right to report them.

The problem arises that original creditors are not bound by the fdcpa. The FDCPA applies only to debt collectors, and it specifically spells out that a creditor is not considered a debt collector.

So someone like a credit card company can call you at work to collect> I mean the ocassional call I understand but Sears calling 2x a day everyday at your employment,can they really do that?

If it is Sears collecting on its own accounts, then yes. It doesn't make much sense for them to keep calling if you tell them to stop, because it would be a fruitless effort and it would alienate the customer. But they can so long as it does not constitute harrassment. (Albeit, what constitutes harassment? It is a subjective word.)

Now if they send it to a collection agency, the CA is bound by FDPCA and if you tell them to stop then they have to.

I simply told them hey if you keep calling my job then I wont have a job and you wont ever have your money.
