How To Respond to Debt Collector
Date: Mon, 12/18/2006 - 23:06
A couple of weeks ago I found a letter on this board to foward to the collector asking them to validate the debt. I received in the mail from them a letter "requesting my assistance so that we may reach a quick resolution to your dispute." It sounds to me they can not validate, so they are trying to turn the tables on me and make me do their work for them. They want me to "mail or fax cancelled checks, paid letters, police reports, or any other documentation I may have to support my claim". The Florida statute of limitations has expired and they did not attempt to validate the date by any of the means I mentioned in the letter. Any suggestions on how to handle from this point are greatly appreciated.

I would let it be. Plead the 5th on the grounds it may incriminate you... you are not required to prove that you owe the debt, they are.
They know it is past the SOL, and they are probably trying to get you to "admit" to a debt in writing. That can actually restart the SOL clock.
Don't let them win; just keep copies of all your correspondence and since they cannot validate the debt, they cannot collect on it.

Thanks, Debtcruncher - I was thinking the same thing - the ball's in their court. Let them provide the burden of proof.
