On 12/7 midland credit management received a Validation letter from me with specifics of validation. I received this past weekend a letter from them "requesting your assistance so that we may reach a quick resloution to your dispute." They say they are attmpting to verify my dispute and want me to send them documentation to substantiate the dispute. Sounds like they want me to make their case for them. They also say they have requested "that the three major credit reporting agencies change the status of this account to "Disputed" with a footnote "Your credit report will not be updated if the federal reporting period has expired, or we have not previously reported on this account.(what does this mean).The specific problem they have is that the Florida statute of limitations has expired on the account.
Any have advice or ideas on how I should respond to this letter. My first thought was to send a statement along with a copy of the original letter back stating they had failed to validate with the specifics requested and if they could not validate within the next 15 days, a law suit would follow for the damaging information placed on my credit report which they are obviously trying to avoid by changing the status of the account to "Disputed." Any help is appreciated.


It is not your responsibility to prove the account is not correct. The footnotes mean this. 1. If the account is older than 7 years, they will not change it as it should drop off your report. 2. If MCM has not reported to your credit report, then they do not have the ability to make a change to your credit report. MCM can only change what MCM has reported.

I have had a run-in with MCM and caught them creating false documents to "validate" an account. Watch them carefully and seek legal counsel if they do not follow the law.
