I'm in California I have 4 loans out and one I took out Dec 4th with CTC.

I cant pay anymore bills and I have decided to file for BK. My attorney says to close my checking account and that the BK will cover all of my PDL's. However I'm seeing people who are having their payroll depts contacted.

My question is that is the BK truly covering the PDLs and should I contact my payroll dept?
Also will they get my new bank account number and take money from that?
Thanks
Jeff

Hi! Welcome.

As long as you claim those loans in the BK, they will be covered. You can't be garnished more than one thing at a time, and BK takes precedence.

You can, though, have a wage assignment honored against you, so MAKE SURE you claim those PDLS in your BK. You just don't want the hassle...

I called my lawer yesterday. We are going to file in 3 months while we gather all the information, taxes payroll stubs ect.
That will be outside that 90 day window. My fear is what happens durring that? Do they continue to hassle me or try to take my wages?

I've cancelled my banking account and my banker said they will not pay anything to them. So will they try to sue me before then or try to find my new banking acount?
Thanks for input

I have no idea about BK. I have had an excellent credit score my entire adult life. Never late. Never short. Ever.
Well, I am now finding myself in a major life changing situation ... I am out of money, work and my spirit is destroyed. I will soon be out out my home. This is humilating at best. My question is: How does BK save you? How does BK truly WIPE THE SLATE CLEAN, so to speak.. as advertised... and not continue to haunt and follow you forever. I personally, have paid MORE than my share over the years.. but that is not the issue. What do I file if I have depleted everything? I would like to keep one credit card and my checking account. Everything else will go. Please help.
