Recently, this month in fact, I was contacted by a collection agency. This is a result of signing a contract with a Health Club for two individuals including myself. This was done 16 years ago. Not once did I ever step into this facility nor did I ever use this facility. In fact, I can't even remember where this place is or what it even looks like. Not once have I received any report from any agency or collection agency until this year, 2006. What about the SOL? Negatitions potentials and possiblities? What can I do to resolve these "wrong" issues with this collection agency?


You can send the collection agency a cease and desist all communications letter. This debt is too old to be reported and probably too old to be collected by legal action. Attempting to "resolve these "wrong" issues with this collection agency" may only lead to further headaches because they need to collect to make money. The last thing they want to hear or believe is that you do not owe the debt.

If the contract really is that old and past the SOL, and you haven't don't anything recently to restart the SOL, like make a payment....

Then I would tell them to sue me. Take my @ss to court and we'll work it out there!

Send them a cease and desist letter on all calls. Then their only choice would be to sue you... but if they did you would have a positive defense and it would be tossed.
