Judgment against jdb?

I had my court hearing yesterday with LNVN and they did not show up after they had 2 continuances on it. The court clerk came out and told me they judge made judgment against them since they didnt show up and i was done there.She did tell me they had 30 days to appeal it at the courthouse .My question is , she didnt say dismisssed but judgment against them, would that be the same as dismissed?


Also I'd like to add I'm the same guest who has mentioned my daughters injuries from being hit by a truck a few years ago.Well she also had her hearing the day before me and they found in favor of her!!


Generally if the plaintiff doesn't show, the court just dismisses the case for want of prosecution. The only way I could see them getting a judgment against themselves is if you filed a counter-complaint and they were not there to contest it. It is also possible that the judge awarded court costs in your favor... after all, they dragged you to court and you probably had to pay to file your appearance. The judge may be letting you recoup those fees from LVNV.

You should be able to get a copy of the case records, and see if there is actually a judgment against LVNV in your favor.

O.K Thanks alot for your reply.I'll check the court records in a week or so and wait out the 30 days and see what happens.Hopefully this is all over with now.Thank You for all your help,you have given alot of of helpful information to me and to others as what i've been reading in this website.

Thanks dbaker.Even if she had lost in my mind she would still have been a winner because of her strength after all shes been through.

I have a few more ?s regarding my recent court appearance with LNVN. I received a letter from their attorneys the day after i posted this and also the day after my hearing.

It was apparently sent to the magistrate handling this case and to me also..It was a letter asking the judge to dismiss without prejudice the complaint against me.

I've looked this up to see if i could find what it means and I've come up with it means that they asked for it to be dismissed but the claim can be brought against me again if they desire. Does that sound about right?

Also how would this play a role in the judges decision the day before? I am just so confused about this all now.I would asssume the judges decision would have to appealed if he ruled with prejudice,which i dont know if he did or not I was just told by the clerk his decision.

Also should i be receiving something in the mail regarding his ruling?

Sorry one more?. If this claim would be brought again it would have to be filed as a new claim right not just as part of the old one?
