Are bad check charges filed on payday loan defaults in Texas

I have a payday loan with Advance America in Austin, Texas. I am unable to pay it at this time. I want to set up regular payments on the balance of $1083.00. Can bad check charges be filed on me when my check is returned?


The state laws vary in every state. I am not sure about the laws in Texas for writing bad checks. You can have the confirmed info from your DA's office.

Under ordinary circumstances, if the creditor takes this thing against you, it will be reviewed whether you were doing this intentionally or it was an honest mistake and because of circumstances beyond your control. In most cases, if the judge finds you innocent, he will prepare a payment plan including the charges and the creditor's legal fees and costs. However, if this is not a first offense, or if the bad check was written intentionally, knowing that it would not clear, then the judge will decide the case according to the laws in the state.
