The bottom line is, they are trying to get you to pay... they want to talk to you and for you to tell them when money will be in their hands.
When they leave messages, they want you to call them back; when you don't call them back, they leave more messages threating court, just to get you to call them back.
When you finally do call, now they want you to tell them you will pay. If they don't like your answer, out come the threats again, until you tell them what they want to hear.
Most of the time, they want to do this without going to court. They will leave a thousand messages, hoping one day you'll come into money and just decide to pay them.
When they deem that their only option is to sue you, then that is what they will do. Calling them every once in a while is usually a little better than ignoring it completely.

I went through this with another - I'm guessing the other was a CA and this is a Debt Buyer (M.R.S Associates). I talked to them and explained that there was no way for me to pay any of my debt - my sole income is SS and had no other assets.
They still continued to call, day in day out. They called and would tell me they were going to make a decision that day. "OK", I would say, "have a good day", and I'd hang up.
They'd call again and again and finally I just stopped answering the phone.
Finally they did give up, and the new CA/Db is calling. I suppose I could answer so that I could officially get their name and send a cease and desist order, but what's from stopping them from just selling it to the next CA/Db and restarting the process?

The other company purchased the account thinking that they will be able to recover the cost along with their profits. It is very important to keep checking your credit reports so that you know which company is reporting what? Collection entries lower the credit scores adversely. You must take care of all those entries that were not legitimate and have been reported fraudulently in your file. Don't let your credit scores go down because of wrong reporting by the collectors.

You could end up in court for not returning calls and refusing to pay your bills. It really depends on the amount of money you owe. If it is over 500 bucks I'd say chances are decent, if over 1000 chances are good and if over 1500 chances are excellent. Of course it's not a guarentee.

I think you should call them back. As you can see, the calls will not stop until you do. You have to know that. Especially if it has been 6 months, and they are still calling. What can they say to you that you are afraid to hear? The calls will not stop that is what a collection agency does. Or you might be on a dialer system, WHICH WILL NEVER STOP CALLING. Just call, even if to tell them not to call you.

You know it is very funny to me how everyone is playing the victim role. I mean, what, did you all think this was free money. I also hate the collection calls i get but unfortunately i put myself in that situation so i have to play the cards that are dealt to me until i become the dealer.

i think it is not so much as people feeling victimized, they are not being handled in a professional way and it is not fair. their are laws that require certian things and there is so much fraud going on, it is hard to just pay money to anyone, or to even talk to someone about your personal bus. without validation.

you seem to be very interested in the posts on the forums. Is there a reason why you are intent on attacking everyone who posts, by saying they are playing victims, etc.?
We are all here to help each other. Please keep your posts to the point and avoid attacking other members and guests. No one here is trying to get out of paying their debts. We simply want the payday loan companies to be held accountable to the law of the state they are lending in. As you can see by the posts here, many do not. As far as collection agencies go, we are simply asking that they utilize legal collection procedures - not threats and extortion.
Let's keep the posts on point, shall we? We are all here to help each other.

I'm not attacking anyone, I'm just a very honest person that gets straight to the point. Now if i'm offending someone, I whole heartedly apalogize, but unfortunately I don't beat around the bush. Everyone is saying what the CA are doing wrong but what about what we debtors as a whole are doing wrong. I understand things do happen, but we all know that those new pair of shoes and outfit can wait until we get our bills payed. If we take care of business than we'll put these people out of business and no one will ever have to worry about being threatened w/ their scare tactics.

Pooh, I appreciate your apology, and I see where you're coming from..
Please understand that there are a lot of people here who honestly want to take care of things and are looking for help..I've been in that situation myself, and I know that debt is terrifying and overwhelming. Sometimes it's difficult to solve things effectively with the debt monster breathing down your neck, and that's what we're here for..To offor opinions, experience and help.

I do accept Pooh's apology, and I wasn't jumping all over him. But if you took time to read other posts on this site, Guest, you would see many of them from Pooh, making blanket statements about debtors playing the victim and not paying their bills. THAT is what I was talking about in my post, and I'm sure Pooh understood that.
Pooh - I do understand your point of view. All I was trying to point out is that not everyone is running around spending money indisciminately, and not paying their bills. Many of us HAVE been victims of illegal collection practices, and that's what we're here to fight. We don't object to collection agencies doing their jobs. What we do object to is some agencies' willingness to do anything to get their money - including threats and violation of fdcpa.

This is for kyside38, how could you even say that if theses payday loan companies followed the law, we wouldn't be here. How is that so, people would still be in debt and complaining about owing someone money. And all in all, you may not go to jail for this but they can very well take you to court and sue you. Then on top of what you already owe, you'll have to pay attorney fees and court costs.

I understand that some people are trying to do the right thing to pay their debt off, but some people use the problems that they have w/ the ca as an excuse of why their not going to pay off their debt. All i am saying is that people wouldn't even be faced w/ the problems of ca if they just contact whoever they owe and set up arrangements to pay them back rather it be $20 here and there.......ACTIONS SPEAK LOUDER THAN WORDS

I, too, feel that debtors should pay their debts - however and with whatever money they have. I don't condone the actions of those who simply won't pay and then complain about the tactics the collection agencies use to obtain repayment.
Our main issue on this site with collection agencies is the agencies that utilize illegal collection practices, such as threats, to try and get the debtor to pay. And of course, then there are the agencies that attempt to get money out of someone who doesn't even owe the debt, and the agency won't validate it - in which case, the "debtor" has every right to be upset and comes here to find assistance.

Pooh, Sorry I took so long to answer. Yes people would probably still be in debt. But not for payday loans. I personally would like to see every one of these predators shut down. 600 plus interest. That is a predator ready to pounce. Then they turn it over to the scam artist collections when they are ILLEGAL in my state. Thats why I advise to send in complaints. The more the better. Fight Back and pay what you owe only not what they want!!! KYSIDE38

I'm not any different than anyone else. It's the fear of being threatened. The minute the phone rings, that fear of an unpleasant and intimdating experience takes over. So, I meet them halfway. If they are decent to me, I talk to them. If they aren't decent to me, I give them my e-mail address and ask the to correspond in writing in the future. This keeps the intimidation at bay and builds a documented history in writing. People are less inclined to be threatening in writing. I've had some very productive correspondene by insisting on putting things in writing.

Maybe I have been lucky and only had one nasty collection call. Most were always pleasant enough. I could never get angry at the collectors. I did owe the debt. I was almost glad to hear from them. I considered it a wake-up call for me. Just because I quit paying the bill doesn't mean that it just goes away and I figured they had heard all the "why I can't pay" stories known to man and were certainly not interested in mine. So I did what I could to work something out. I have had some tough times and had a lot of calls from collectors. For the most part I never had trouble working something out with them. I must have had better luck than everyone else.
