Solicitation of a post dated check is against the law, so if you do one over the phone and it bounces, the CA can not prosicute. I worked for a CA that told people that they would prosicute on the worthless check, but a post dated check is just that. So if a CA tells you that they have to have one, you tell them no.


I have an acct with AR Mgmt and they are to take out a check on 12/29/06. They say that if the check bounces then they can get me for writing a bad check, so are you saying they can't?? I called them on 12/05/06 and told them that they money wasn't going to be there and they "manager" said that he guessed it would bounce then..

I just spoke with the guy there, and he said that I signed a Verbal contract and I had to follow it. He said that they can report me to the check writing database for writing a bad check. I told him that the funds wasn't going to be there and he said that they would just report me and I would have to pay the balance in full within 24 hours..
