Need help fast!

I just woke up from another bad dream. I have a court date Jan. 2nd, 2007 for 6 tickets (a few FMFR's and expired reg., nothing else). I got arrested on Nov. 12, 2005 after failures to appear. I got bailed out and reset the court date. But as it gets closer, I can't help but think that they'll find out I owe a bunch of companies and toss me in jail. Or find out I may have warrants in another county and arrest me(which I may have). So much going through my head, i can't sleep. Any suggestions? I am actually contemplating suicide, because being in jail is the worst feeling EVER!

I'm a paralegal, and I'm not giving legal advice here, but know this. Your financial situation has nothing to do with the court system. The courts are only interested in your obligations to the jurisdiction where the violation occurred. I'll be honest, if you have a warrant in another county, it is possible they would have that information because the information is probably in a central database.

However, suicide is NOT and I repeat, NOT the answer. If you can't afford an attorney, second best choice is to ask for a public defender. They aren't as good as an independent attorney because their boss is the jurisdiction that has the charges against you. But they can help to eliminate jail time. Ask for a plea in abeyance. That will give you a chance to be placed on probation and set some conditions with the court. If you comply with the terms of the agreement with the court, the charges go away. if there's a fine, work out a payment arrangement you can afford.

Keep in mind that the courts and the judicial system are not out to punish. Their job is to collect income to the city, county or state, depending on the jurisdiction. In short, all they are bill collectors. If you don't have it, they have no choice but to work with you. And yes, they could choose to jail you, but why? Do you know how much it costs to jail somebody on a daily basis just to pay off a warrant? It doesn't make sense. Here's the court saying you owe money to them and if you can't pay then THEY want to spend money on YOU so you can make up for the debt by sitting in their jail? Something's a little bassackwards here. File a Affidavit of Impecuniosity to show that you can't afford an attorney. Ask for a public defender and then tell the defender what you want. The public defender is there to represent you. They aren't there to make you jump through hoops for them.

Hope this helps. Oh, and P.S. no matter what, the people in the court system are not the brightest bulbs in the room. They are people just like you and me. Give them respect, but don't be intimidated just because they wear a uniform or a robe. Imagine them in a pair of shorts and a tee shirt, and you will find yourself feeling a lot more comfortable and able to deal with all of this. Good Luck.

I agree. Committing suicide is not going to make your problems go away. First of all, you have to look at your situation once you get a good night's rest. Lie down in your bed and try not to think about it for one night and rest. Then in the morning, sit down and examine the situation.

Your payday loans have nothing to do with your tickets. That is the first issue that you need to work on before you can eliminate your debts (you can go to jail for the tickets or pay a fine but it won't do you any good to be in jail and trying to pay loans).

As for the loan situation, have you tried to contact each of these companies to see what can be done to pay your debts? Have you checked your state laws to determine whether there is any pending litigation or whether these loans are legal in your state?

Like I said, you can not do anything while sitting behind a jail cell. Examine your legal situation first and then focus on the payday loans. And please, continue to visit this board to let us know what is going with you. I know what it is like to have the weight of the world on your shoulders and you feel as if the only way to eliminate your problems is to leave this earth but this is not the way. Trust me, you have to believe that everything is going to be all right. I was in a similar situation as you and thought that by killing myself, things will be okay but I found a way out. You have come to the right place.
