what can they do about a car that was repossesed 4 years ago

I was contacted last week about a car that was repossesed about 4 years ago. I have no income except child support and that is 400 a month. I'm a single mother in college and i sub at my youngest sons school when needed. They are wanting me to pay $51 a month. I don't have it to spare. Is there anything that they can do? I'm going to file chapter 7 in Feb. when i get my cost of living loan from school.

I would recommend speaking to a bankruptcy attorney now - not in February. At least get some advice on your situation and ask about the repossessed car issue. Many bankruptcy attorneys offer a free initial consultation.

I talked to an attorney about it last year but i never did it.because i did not have the money. I will not have the money until Feb.Is there anyway that they can take my child support?

Do you mean during the bankruptcy? That money can be counted as income, but they don't take your child support - they will take the payments for a Chapter 13 payment plan out of your paycheck, if you have one.

Since you do not have a paycheck to speak of, chances are, your attorney will recommend a Chapter 7 bankruptcy rather than a Chapter 13. A Chapter 7 will eliminate your debts, but it will also cost quite a bit to file. I would at least speak with an attorney right away on this issue, and give him your details regarding your income and debt. He will be able to point you in the right direction.
