I have posted a few times over the last few months about LVNV and the suit they brought against me.Well its been 3 months now and they still have not validated it for me.The judge dismissed it without prejudice when they did not show up at hearing,but seems they wanted it that way anyway because 2 days later i received a letter from LVNV that they apparently sent to the judge asking for it to be dismissed without prejudice,and in bold lettering stating that it has not been settled yet.

Well no wonder it has not been settled yet, no validation ,no settlement, I am not sending anything until i have it validated.I also understand that without prejudice leaves it open to bring another suit against me on the same claim within a year.Which kinda scares me as to what they may try to do next.

I am still receiving many calls a day from them .In fact i received 1 call within an hour of hearing date. My ? is should i send a follow up letter to them about validation and what should i say in it? Also how do I word a cease and desist letter to them? I just want the calls to stop.

Am i wrong in my thinking if they had the validation they should have just went to court and had a judgment against me and had it over with instead of calling 4 times a day and harrassing me?


Guest- you are right. Dismissed without prejudice, means they have ,I think, a year to bring it up again. But since they didn't show the first time, chances are, they won't the second. I have been dealing with them for almost a year, debt validation, then follow up-on and on. I would send them a follow up letter, with a copy of your dv letter, saying that it hasn't been fully validated. Then in about 30 more days, send another follow up. If you have to go to court, you will have lots of paperwork to back you up. Just say to cease and desist from contacting you via phone, only can be done by mail. Sometimes this makes them mad, but it is supposed to stop them. With LVNv, I found they break alot of fdcpa reg. Keep us posted on your progress..Karen :D
