Welcome to the forum. Since you have registered here, a debt counselor will be contacting you shortly after the holiday. He/she will be able to go over different options available to you and your friend. That's a long time to have that kind of debt. The best of luck to both of you. P.S. It's better not to give your personal information here. Since you have registered, you will be able to PM any member here, and they will be able to PM you. Again, good luck!

I really believe that they should not pursue anyone that 92 years old for a debt that will probably not be paid for in that person's lifetime.

Alexandra - you'd be amazed. I heard a story on the radio the other day about a woman who died just after paying her only credit card completely off. She didn't close the account, however, and after she passed away, the credit card company charged the annual fee of $60 to her card. Several months passed, and finally a relative called the company to advise them she had died, and that the account should be closed. They demanded payment of the annual fee, which had by now accrued interest. He kept telling them she was deceased, even faxed them a copy of the death certificate. They insisted it still had to be paid.
He finally offered them her forwarding address at the cemetery and left it at that.

Now that is beyond ridiculous but good for the person who forwarded the letters to the cemetery. That doesn't make any sense at all. Who will they think will be paying for the debt when the person is dead?

I know - the way the story went, the relative that called the credit card company kept telling them she was deceased, and they kept telling him the charge would still stand. Even after he sent the death certificate, they wouldn't back down. They finally ended up telling him "our system just isn't set up for death".....so he offered to give them the forwarding address. When they found out where it was, they said, "SIR! That's a CEMETERY!" He said, "well, I don't know what you do with dead people on YOUR planet..."
They never got their money, but I don't think they ever called him back, either.

They should have an age limit when they stop trying to collect from these people. That's just awful.
I feel the same way. That doesn't mean people of a certain age
I feel the same way. That doesn't mean people of a certain age should be able to run up thousands and thousands in debt and not pay it, but I think there should be a limit to the collection practices used on the aged. We don't respect our elders the way we used to, on many levels.
Right. I mean like this woman who has been paying on this debt
Right. I mean like this woman who has been paying on this debt for 37 years. That's pretty ridiculous.

I know - that's the problem with making the minimum payment - it will never get paid off that way, and that's precisely how the credit card company wants it. Sad.
I can't believe such ppl. I hope that I never get a cc with them

Since I work in probate and estate planning, here's my two cents. When a person dies, their estate gets probated unless they put everything into a trust. If their estate is owned by the trust, the trust pays. If the estate has to go through probate. In the process of probate, the court places a notice in the local paper advising creditors of the death of the individual and gives the name and address of the personal representative appointed over the estate. If no one responds, the debt is cleared. For anyone responding, the personal representative pays the debt and then the beneficaries of that person's estate gets the remainder.

P.S. I would recommend paying the debt off if possible so the estate doesn't have to pay it. If it's anticipated that there won't be much of an estate and/or she has already willed her property away, ignore the debt.
