Well, I live in NC and PDL's are illegal here, right? I sent him the email about a month ago and he has just been sending the same on back that says it is under review, please be patient. Anyway, I got this one and here is what I sent him back..

Just sit down and relax. I have had dealt with Cash Today and my experience with them was similar to you. Finally, I was able to get the account marked PIF after a lot of running around.

You have enough reasons to prove that you have paid excessively for your loan account in NC where pdls are illegal. Cash Today is trying to add illegal charges on your account and they are placing a settlement proposal to you. You don't need to pay anything more. Just report to your AG and let them communicate with Cash Today. They have already violated so many federal and state laws. By paying more, you will only lose your hard earned money to waste.

Natdust, are you scared now?

That's what Darren wants!! He wants you to fumble so that you pay him $79. How will you be assured that he is really going to mark your account "PIF" after getting the money? And where do you need to send the money? Checking account or by money order?? Cash Today is showing you the UK laws. Legally speaking, they are violating the laws in US. You have to make a decision!!

I looked up this company on the Better Business Bureau site. The have an unsatisfactory rating and I noticed at the bottom of the report it had the following information.
Competency Licensing
This company is in an industry that may require licensing, bonding or registration in order to lawfully do business. The Bureau encourages you to check with the appropriate agency to be certain any requirements are currently being met.
Also the company is based in UK and uses a Nevada address to avoid international postage charges.

I would point out the fact that they are not licensed to do business in the US which are the law that they need to follow.

I have told him all of this and they still keep going on and on. I am tired of fooling with them, so I am wondering if I should just send them the $79?? This is the address that Darren gave me to send the payment by money order..

Nat, where did they get the $1485 from? Knowing they are illegal, I would continue to stand firm against them. Where's Steelers? She would tell you to e-mail them everyday until they finally give in. Don't let them get away with it. You need to start harrassing them like they've been harrassing you.

stick to your guns, dont send them a damn dime..i got threats like that but guess what i research my applicable laws and let them know i knew what i was talking about and got a PIF letter..tell em to forward their legal investigation team and information to your state AG since thats where your complaint will be. If they are using a nevada address and arent licensed in the US then they would have no legal standing as i understand it. So i dont know what they could really do. What do your state laws say about PDL's. Thats what the company must abide by no matter what they tell you..i got that straight from the AG's office today

don't let them scare you. I don't know if this company and Rt. 66 are one and the same, but they are using the same scare tactics. "Legal department", my hiney. They don't have one - unless it's to defend their worthless selves against lawsuits.

I'm all for paying back what you borrowed, plus the allowed state interest, but when you have overpaid and they keep threatening, that's when I get irritated at them. Don't let their "legal department" threat scare you. I received the same threat - they said I had 3 days to contact them before "work would begin on my file". I ignored them - I had already made a settlement offer, which they declined and attempted to extort more than $300 out of me (I only owed $23). After that 3 day deadline passed, I didn't hear from them for weeks...then they popped back up in my e-mail saying I was being referred for "further processing by the legal department", and I had 2 days to respond. I ignored it. That was almost 2 months ago.

If you have already paid back what you borrowed, I would ignore them. They cannot do anything to you, because they are operating illegally in your state, in this country, and in their own country, based on the UK laws. They can't sue you, they can't garnish your wages, and they can't arrest you.

Whew. Ok. Off the soapbox for the night.

Nat dont give them another dime. They are blowing smoke. Payday loans are prohibited in NC. They cant do nothing to you at all but try and scare you. Send their e-mails to NC AG he will respond to them. KYSIDE38

Nat, How about sending them an email back asking for the name of a contact in their legal and investigation team plus asking them for an email address epcifically for that department. Then start ALL over and send that department your letters you have. Also have you filed cmplaints with the AG in your state, the state where the company is located plus the FTC, also try these people American Collectors Association and of course file with the BBB. The worst thing that happens when you file complaints with these org is nothing so why not try if you haven't already.

Dont let them scare you!!! You know what the law says and stick to your guns. I would stop offering any money to them at all and start asking for a PIF letter. You got them to concede money now just drop that if you have payed what you are required by your applicable state law. They cant and wont pursue you in any kind of court because then that would subject them to scrutiny they dont want either. I would just ask for your PIF letter and in the same breath let them know you will report them to the proper authorities for their illegal practices. From my personal experience the last couple weeks once they figure out you know what you are talking about they may back off just to make you go away.
