bluegirl -
you cannot be arrested simply for defaulting on a debt. There is no debtor's prison anymore.
And don't pay by western union or money gram. They are not easily traceable, and if the company says they didn't get it, it's their word against yours. He needs to give you a physical address to send a money order or check to.
Stand firm with him - don't let him intimidate you. Others will post more advice here as well - keep an eye on this thread. We're here to help! :D

Bluegirl welcome to the forum. Take a deep breath, relax and take a step back. I have been where you are and so have many of the others here on this forum. No he cannot do that. If you stick around, and read the threads here you will find out that this is a scare tactic that many of the collection agencies use to get you topay the way that they want you to pay - not the way that you can pay. It has been said many times here by the members in the know - THERE ARE NO DEBTORS PRISONS. I have learned a lot from everyone here so can you. One of the most important thing that I have learned is to take control back from the pdls. Through this forum I have regained my confidence. Stick around I know that you will too.

I too deal with T&C, give them what information you do have and tell them to call and contact this person. Do not let this a$$ scare you at all. You don't even have to talk to him---tell him to call T&C, give him the number and hang up.

i went to the paydayloaninfo.org and it says:
Prohibited by Small Loan Laws or Usury Caps
Currently twelve states and two territories have small loan laws or usury caps that effectively prohibit payday lending at triple-digit interest rates. In Arkansas , the state Constitution caps rates at 17% annual interest, but the legislature enacted a law that permits check cashers to make single payment loans based on check holding. The constitutionality of payday lending at triple-digit interest rates in Arkansas is being challenged in the courts.

It doesn't matter if they are in your state or not. If they are prohibited, that means that the loan is considered illegal. PDL companies have to go by the laws of the state of the consumer. They will tell you that they don't have to go by your laws, but they really do.

bluegirl - we won't give up on you! Many of us have been in your shoes, and worse. No one gave up on us, and we won't leave you hanging in your situation, either.
First off, play tough with this guy. He's only playing tough with you because he thinks you don't know your rights. Call him back and inform him that you are reporting this ILLEGAL loan company to your state regulator - and then do so - immediately. File the complaint with the regulator and the BBB as soon as possible. Give this guy as much grief as he has given you. Tell him you KNOW that he cannot take you to court or put you in jail. Guess what would happen to an illegal loan company that tried to take you to court?? THEY would be the ones in trouble, for lending into a state where payday lending is prohibited.
Stick to your guns and get tough with this guy. He might bluster a bit, but he'll eventually fold when he realizes you know the law and your rights.

Most of what this guy said is a total lie. No debt prison. He IS required to send you a verification letter explaining the debt AND an address. You are not forced to pay via Western Union or anything else. These are all very standard actions by immoral collectors.
Stay here - we're with you. Know your rights and throw them back at the guy. The moment he realizes you know the law, you will hear him starting a new song.
