Misinformatoin regarding fdcpa laws

Hi. This is Jeff Foster. I am an account manager with Global Financial. Several people have called recently and have stated that they learned about the fdcpa from this website and that I am not complying with the FDCPA. Today, a debtor named NAME DELETED FOR PERSONAL PROTECTION OF THE DEBTOR - SUEBEE from Texas said that I was not complying with the FDCPA or the Texas laws.

WE ARE NOT A THIRD-PARTY COLLECTOR!!!

THEREFORE WE DO NOT HAVE TO COMPLY WITH THE FDCPA!!!

ONLY THIRD-PARTY COLLECTORS HAVE TO COMPLAY WITH THE THE FDCPA. THEREFORE, WHEN I THREATENED TO HAVE DEBTOR'S NAME DELETED - SUEBEE ARRESTED, I WAS NOT VIOLATING ANY LAW.

Furthermore, only Delaware law applies to the terms of the loan and loan repayment. Therefore, even though DEBTOR'S NAME DELETED - SUEBEE has already paid $1,225 on a $350 loan, we can still charge him $590.00 for repayment and default on the loan.


And it's not like I posted this ******name edited out*** creep's personal information. I didn't even post his actual loan amount. I exaggerated it all to piss you people off. He actually really has a valid debt seeing as how he only has paid $315 on a $350 loan. By our valid calculations, he still owes my esteemed company $590 more.

I have never had a payday loan, so I'm really not here to defend myself.

But I operate a legitimate finance company in Illinois. My company is licensed, and my name appears on the license as being a secretary of the corporation. In order to get our license, I had to pay an insurance company to put up a $100,000 bond just in case I decided to break some laws. And when the state auditors come in once a year to look my books, the first thing they want to see is my copy of Illinois laws pertaining to loans. If I cannot show them my rules and regulations, they fine me $500.

What's my point? I really don't have one.

I will just ask, what does the title account manager really mean? I have about 10 account managers on my staff, and all they do is make phone calls. I pay them just above minimum wage. They come and they go. And what I find funny is that I get just as many collection calls coming into my office for my account managers who don't pay their own bills. Jeff, do you pay your bills?

O.K., now I'm in this and so is an advocate from Utah who is working with legislators in Utah right now to change the PDL laws here. There are currently 5 bills before the legislature now. I'm pretty sure that at least one will pass. However, to address your contention that you don't have to be licensed, I refer you to http://www.tax.utah.gov/forms/pubs/pub-38.pdf

This is a 77 page document published by the Utah State Tax Commission advising how and why you need to be licensed in Utah to do business. You state that you are. If so, under what name? CashNet500 isn't licensed. Payday-Loan-Yes isn't licensed and yet it decides to set up shop in Murray, Utah. (Someone really ought to talk to property management companies about checking on the valid authority of a entity to do business in the state before it sets up shop) and Global Financial is not licensed. So, where is your proof. Please provide your Utah Entity number (hint: it has 7 numbers offset with a dash and another 4 numbers). What is your NAICS code. Who is your registered agent in Utah and don't tell me CT Corp. The fact is that you guys have set up shop here, are doing business here without legal authority and you are running a lot of money through this state without proper licensing. The Utah State Tax Commission will be apprised of this newest discovery and it is a matter of time before the doors at 4001 South 700 East, Suite 500, Murray, Utah are shut for good.

Hey JEFF< If Steelers is citing a story thats not true why are you being sued by the WV Attorney Generals office? Payday lending is ILLEGAL in WV. FIGURE THAT ONE OUT SMART GUY!!!!!!!!!!!
