collector is refusing to let me speak

How do I make a payment arrangement with a collector on a credit card debt I owe if they will not talk to me? Everytime they call my house, I answer. They keep asking me why I am refusing to pay. Everytime I tell them I am not refusing to pay (I know I owe the debt, and saying that I refuse to pay opens them up to start the legal process)they speak over me, or even yell at me. The company's name is Daniels and Norelli. They WILL NOT set me up on a payment plan, and the debt is only $900.00. What can I do now? Do I just start sending payments anyway to cover myself incase of court? Has anyone else dealt with this company?


Don't start sending the payments without any documentation. You need to make sure that this company is actually authorized for collections. Call the original creditor and inquire about your file. You will come to know if they have hired this agency. Also, propose your payment plans directly to them so that you don't have to deal with the CA.

Collectors must be licensed in your state before doing collections. Check them with your state DFI.

Did they send anything in writing to you?

Get the debt validated by the collector. Send them this letter. Once they give you the required info, send them your proposal letter. It will be very clearly understood that you are not refusing to pay your debts.

You will cover your legal basis after they receive the letter. The ball will be in their court and will have to provide you the information about their legitimate collections.

are scaring me. they refuse to take a payment plan. they gave me 48hrs to come up with $4,000.00. i am backed up against a wall. I need help with what to do.

did they send you anything in writing?if not you have the right to demand it.do not let them scare you.debts are civil matters,and they can't do anything in 48hrs.next time they call demand something in writing.do have a phone#from your caller id?that might help find an address to send DV and C&D letters.

I do have a phone number but I am having a hard time getting the address. When he calls I ask for the address so I can send what I can afford and he refused to give it to me. I want to send $100 a month on a $12,000.00 debt.and he said I can't tell him what I want to do, he tells me. and a $100 a month isn't good enough. He told me to try and find someone who cares about me to give me the money. He is calling back on Monday Morning, I have been jumpy all day I guess because I am afraid my husbands employer will find out and think he is not trust worthy!

that is typical bottomfeeder speak.have your husband tell your boss this is a fraud company if they call.what number comes up on the caller id?just know again this is a bottomfeeding humanoid.do not give him anything over the phone.he cannot do anything he threatens.

Google Daniels and Norelli....you will see the rip off reports near the top.

When he calls tomorrow, tell him you are NOT permitted calls at work (if you are at work) and hang up. Have someone witness the statement if possible. If he calls you back, you just made $1000 for an FDCPA violation. Immediately mail the DV tomorow

I sent the dv letter today certified mail with return request and when I got home from the post office I had a letter from them that states they were retained and I had 30 days to dispute. Now what should I do? they should get my dv tomorrow.

Work ceases can be verbal. The FDCPA words it if they know or have reason to know that the employer doesnt permit calls, they cannot call. The debtor telling them no calls at work is sufficient.

Also if you talk to the collector, talk in a very soft voice....it forces them to listen. This is a trick collector are taught....at least good collectors.

wait.if they still call you can take action against them for FDCPA violations.i doubt you will hear from them again.
