This just happened to me.. what!

I just got a call from a CA I made payment arrangements with. It was for 1 payment electronically and then they said I could mail in 4 additional payments on th e15th of each month until it was paid.

Well they have been nice up until today. I got a call 1/3 from them and spoke to someone who was really nice. I got all the information I needed from them and was told just make sure the payment is to us by 17th.

fast forward to today, just got another phone call from them and the guy was soooooo rude asking me to give him a check over the phone. He actually said "" go grab your checkbook okay. I was as nice as I could be but he was very insistent. i told him I would mail a check, he said if I didnt give him a check over the phone that our arrangemnet/settlement was null (settlement - whatever I never got a deal from them). Anyway he totally hung up on me. Now what do I do?

BTW.. I have to write the check to CITI not them...

AAHhhh I dont know what to do... HELP!


So you def think that if I mail my payment to them for the 15th theyw ill have to apply it? If I include a letter asking for a statement with the remaining balance due, do they ususally comply?

That man made me so angry I cannot believe I didn't loose it. I can't believe that the company itself who might monitor phone calls or record them would allow an employee to hang up on someone.

Sometimes, I think that CA's hope to beat you down by bullying you and making threats. F them. When you know they are calling pick up the phone and say "this call is being recorded" and see what happens. They want you to be in awe or frightened of them. Don't fall for it. Come here for the support you need.

I am being sued by Hosto & Buchan, P.L.L.C., who are representing Bank Of America, for an original amount of $17,000 dollars, but with tacked on interest, is now about $29,000 dollars. I found out that I was being sued when they sent me a copy of a "Agreed Judgement", dated December 18, 2006. They wanted me to sign it and return it to them in 10 days. However, by the time I got this in the mail, it was after Christmas, and the time period to get it returned to their office has gone by. In addition, the envelope that they sent this to me in, has a December 21st Time Stamp on it. I have sent them payments in the past, and I sent them one when I got their recent letter. When I had initially tried to ask Bank Of America to put me on a payment plan that I could afford, to pay the debt off, they turned me down, and told me that they would be in touch with me in the future. Then I didn't hear from them for some time, until I was notified by Hosto and Buchan about being sued. I checked with the County Clerk in the county that I live in and sure enough, there is a lawsuit filed against me by Bank Of America, with Hosto & Buchan as their Debt Attorneys. What are my options, if any? I believe in paying my debt, and I don't want to file Bankruptcy. I just wanted a chance to repay my debt without having my pay garnished and my checking account frozen and seized, which I use to pay my bills. It looks like I will be hopelessly ruined and homeless for the rest of my life. Please, people, do NOT let your credit spending get out of hand, or this will happen to you too!

I am not sure I have any advice for you.

Have you registered with the site? A debt counselor will be calling you if you have to help you with your situation.
Did you say your debt with B of A was credit card? I'm wondering if it would even help if you called Mastercard or Visa directly, depending on what kind of card it was. Just a thought.

If you didn't get the settlement offer in writing from them, then you really don't have anything at all. collection agencies will lie to you over the phone, so you need to get everything in writing from them before paying them anything. And then if you do still really want to pay them-- which I think is a mistake-- pay them with a money order so that they can't drain your account dry. To stop them from calling you on the phone, simply send the a cease and desist letter by certified mail to prove they received it.
