Has this already been to court and a judgement issued?

It is probable that they cannot prove the case. Resurgence Financial is a portfolio so they do not have adequate records on most debt that they own. The attorneys that work for them are not the sharpest tools in the shed. I was an attorney in the creitors rights feild for years in the Chicago market and Resurgence is weak.I now represent consumer/debtors as an aside to my criminal practice. I would post my email but I am not sure it is allowed.

one great peice of information is: A debt buyer could not possibly have a decent witness b/c the original creditor is not going to send a rep from the company. So they will try to trip you up and call you as an adverse witness or use some flunky as a witness and bank on you not knowing when or how to object.

I am having a hard time getting a proof of pay off payment. They had no trouble sending me what htey wanted on time and now I can't get a proof of payment. What should I do now?

Put the burden of proof on them, request validation. on top of the page is do it yourself, click there and you will see a sample letter for requesting validation.

resurgence sent me a lawsuit and here we are 2 years later
and they put a levy on my wifes account, shes not on the account i had w/ them and im not on her Bank account.
