Wow, that is major violation with the fair debt collection rules. I would report this company to the Attorney General's office. Who is the PDL they are referring to?
Some PDL's will argue with this, but they have to follow the laws of the state you live in.
Check out this link also www.paydayloaninfo.org, that will tell you the laws for your state.

Because they are violating the laws and that is why we are telling everybody to file complaints with the AG's offices in your state and theirs and also file a complaint with the Federal Trade Commision. This company needs to be shut down. I just feel sorry for the people who don't know any better and don't have a resource like this website to stop them from sending these idots money.

In Michigan:

-most IPDL's are not licensed, because the state requires a physical signature on documents - not a recorded phone conversation.

-the state requires that certain notices about interest rates allowed by the state be posted where they are visible - a little hard to do over the phone.

-the state requires lenders be licensed and registered with the state, and to follow the fdcpa - which the IPDL's obviously do not.

They cannot arrest you or garnish your wages. They will harrass you to no end trying to get you to pay, but if you have paid back your principal amount, plus the interest allowed by the state, I would tell them to go fly a kite. And file a complaint with Mike Cox, our state's Attorney General.

The link that Pinklady gave you is for searching to find if a business is incorporated in the state of MI.

To find if a PDL company is licensed to do Deferred Presentment services in the state of MI go to:

http://www.dleg.state.mi.us/fis/ind_srch/cons_fin/ofis_consumer_finance_criteria.asp?industry=DP

Actually there are some online PDL's licensed in MI.

I got an email this morning after I told the guy I was filing bk and sent a cease and assist letter. I also contacted the AG in my state and theirs. Here is what he wrotePlease be advised that the law you are referring to only applies to payday loans that you receive from an actual ???????walk-in??????? store, however receiving an advance from the internet is completely legal. Please be advised that your balance is due immediately. The consequences for a defaulted loan were clearly stated in the contractual agreement you chose to adhere to upon receiving funds from my client. I will need for you to provide a date in which you will fund this matter on or before the 01/26/07. Without this necessary information I will have no other choice to exhaust for reimbursement other than to proceed against you with extreme action. Your account was in a defaulted status when it was received in my office, in conjunction with another defaulted arrangement should you fail to confirm and comply with a current payment will provide sufficient evidence for the account to be documented as a ???????willful evasion of debt,??????? which is cause for further action to take place immediately. All mail/email sent/received is recorded and duly documented in your file and your response provides notification of the debt. These notations serve as evidence in the event legal action should take place. Also note non-response will also be taken and noted in your file as an official ???????refusal??????? to pay and further action will proceed immediately. Thank you for your time and cooperation.

rmjacobs - don't let them tell you that. They DO have to be licensed in MI to lend here. I'm not saying that none of them are licensed here, I'm just saying I haven't found any yet. The ones I've checked on haven't been.

But throw it right back at them when they say they don't have to be licensed in MI to lend here - they most certainly do. Print out the law for Michigan, and quote it to them, word for word.
