I received a judgement at my previous address and never received a summons, what can I do about this?


What can I do to clear a judgement off my credit report? I received a judgement against me and I didn't know that I was summoned to court. I want to clear this debt.

:shock: :shock: :( That is a nasty way to find out about court proceedings. First get a copy of complete case file. Then either you or your legal counsel should submit a motion to vacate judgement based on improper service. Be careful because if you are in statute of limitations on this debt,they will probably refile. Do not delay because with a judgement they will look for and seize assets.If they refile make them prove their case completely and show up for all court proceedings.

My son was being sued over a dented hubcap by some jerk, and the summons guy evidently just layed it on our porch. I found it the next day in the yard in the mud. My attorney didn't say much about it when I told him. I think they pretty much have to make an effort to serve, now what they call an effort I don't know!!. But I do know judgements can follow you. Try to get your court clerk to give you a copy, and see if this can't be taken care of. Good Luck...Karen
