CRR--threatening to sue

I put my debts in consolidation with T&C last June. I just rec'd a call from a very unpleasant "legal assistant" from CRR "law firm" regarding my GE Money Bank account (Walmart).

She is threatening to garnish wages because she says her firm does not work with debt consolidation companies and I haven't paid enough money. Now I have been talking with this law firm off and on for the past 6 months regarding how much should be paid etc. I have made 4 payments. Never once did they tell me that they don't work with debt consolidation companies. And she said they wouldn't have set up a payment arrangement of $82 on a 4000 bill anyway. She also said that I had better "get with the program" and realize this. I said I don't have to sit here and listen to you patronize me and attempt to intimidate me. She said "fine" then we will bring a judgement against you. I am so upset and crying that I cannot think straight. I plan on calling T&C in the morning and say what I don't know. Anybody have any words of advice or comfort?


You need to contact T&C first thing in the morning and demand proof of every payment made to CRR and proof that they have cashed the payments. Also, ask for proof of the proposal. Sounds to me like they are wanting more money a month toward the balance owed. I know exactly what you are going through. I dealt with HSBC last year. T&C was making payments to them and they were claiming they weren't receiving them. T&C came through for me with proof of proposal, proof of payments sent and proof that they cashed the checks sent and the date they received them and cashed them.

Lorri, I'm so sorry this is happening! Just when you think it's safe to go back in the water...here comes Jaws!

Try to calm down, and put this out of your mind for tonight. I know it's hard to do, but keep in mind that you can't do anything about it tonight. You can't do anything until you can call T&C tomorrow and get this worked out. Sit down and try to read a good book...or THE Good Book...you'll find it more comforting than anything else I could say. :-)

Try to get some rest tonight, and let us know what happens tomorrow.

The woman said there is nothing in my file and I know thats a big lie, cause I have spoken with them so much. Thanks Tammy---I am calling them in the morning. See they started saying last summer they were going to garnish wages and were really ugly about it. This call came at the end of a very horrible day and I just can't take it anymore. I am beyond despair, sometimes you just don't even want to think about any of it. When she said they were going to have to garnish wages then, I said "well you just will have to then won't you" and I hung up. I didn't want to give her the satisfaction of having made me cry.

You know by now these companies can and will lie to you to get more money out of you.

Talk to T&C and get documentation that they've been paying CRR. Then tell CRR to shove it up their--:)

I'm a lot mouthier than you! :) Especially when I'm sleepy. :) :lol:

Hi Lorri,

I'm sorry to hear this has happened to you. The smart thing is to call T & C this morning and go from there. I would ask if they have anything in writing from the CA or creditor, like a signed proposal form. Just because they have agreed to debt consolidation, it doesn't mean that they won't sue you. I ended a relationship with my debt settlement company and I have been striking out on my own. I have been threatened a lot of over the last couple of months. Nothing has come from these threats yet from the CA but I have also been making monthly payments to the original creditor that they have been cashing. It's hard to deal with but I'm sure you will make it through it. Even if it does come to court, you can show that you have been making monthly payments and haven't avoided your responsibility.

Thanks Mishele---When I spoke to T&C this morning she said that GE Money Bank has two depts--the debt management part and another. They have been making payments and GE has been cashing them. They will be contacting them this morning. They never rejected or denied the proposal. T&C said basically what you said that even if it does go to court, I have the proof that I have been paying.

And Jessi---I can be pretty mouthy (believe it or not), but can't usually think that fast. I did feel pretty good telling her that she was not going to intimidate me and treat me like I was stupid. And T&C also said the same thing as you did too--that they will lie and say anything to get you to pay more money so they can make their commission.

Thanks SueBee too for your kind words. I knew if I came on here, you guys would be my "voices of reason". I will keep you all posted.
