Saw your comment about a Perkins loan.....
Hello, new to the form, and was trying to get to the bottom of AI attempting to collect on my husbands old Perkins student loan. AI wants to withdraw almost $700 from his checking account each month, something we simply can not afford. I called the gal at AI, and told her everything this site has in the ammo bag, as far as getting a letter of debt validation, etc,( no more phone calls, you are being recorded) and thought that they were gone for good. Yesterday they faxed said letter to my husbands work. It doesn't quite have everything that is recommended by the community, and it just doesn't sound right. I noticed your comment to someone about Perkins loans not being able to re rehabilitated. Is it ok for them to try to rehab this loan then? I am lost and scared, and need some help! Any advice? I would love you fwd/fax a copy of this letter for you input. You really seem to know ur stuff! :P thank you, Charity Smith
Perkins loans can't be rehabilitated, but that doesn't mean you
Perkins loans can't be rehabilitated, but that doesn't mean you have to cough up some kind of settlemtn or repayment plan you can't afford in order to forestall a wage garnishment.
Btw, if they sent your husband a collection notice by fax to his workplace, they broke the law, that is a violation of his right to privacy. Now you don't have to play ball with them at all, you can tell them to screw off and make monthly payments as you can afford they and they can not garnish you.
Husbands Perkins loan
Hi , and thanks for your reply. We're still going around and around with the AI people. I guess the reason they faxed to his work was because that was the fax number he gave them. Here is what we've come up with: I checked the University of Kansas' website, and they have a PDF upthat tells that they offer a one time rehab on Perkins loans. I alos founf that they majority of the loan is not a Perkins loan, but some other $30,000 loan. (yikes!) The deal that was worked out between AI and my husband was to have 'the Department' withdraw $396 a month, every month, on the 28th. All the paperwork they've faxed has the wrong date on it, so I called and asked them to simply change the date, and he would sign and return.
**Also, this original 'contract' had the 28th of Feb, with the grace period of the 8th of March, which I told them, ( on March 9th) that he couldn't sign, because the date was wrong. I told them, he can't sign a contract that has a promise to pay something YESTERDAY, can he?!?! They pretended to play dumb, and put me on the phone with 2 other people, after being on hold for over 8 minutes. I told each the same thing I had explained to the last." He needs the contract to be changed to say the 28th of March, and then he can sign and fax back". The last person I spoke to Brandon Booker was telling me that he would do that, but he needed to get the permission to withdraw funds re-instated, that my husband had given them, and I had taken away a few weeks ago, when I got involved. I explined that I couldn't give them permossion to do that, since it wasn't my account. He said "Yeah, but you're his wife, right?' I told them that I wasn't anywhere on his bank account. He asked again, "Well, aren't you attached somehow?" I replied again NOPE.
I have a feeling they are up to something, trying to get permission to withdraw the funds NOW instead of on the 28th. Seems fishy, and we are very leery of paying the loan back to them. Unfortunately, a letter from the Department of Education has them down as the buyer of the loan. Do you think Iit would be worht a trip to a lawyer to help figure all this out?
