I received a call from first credit of america, about a debt with a company I've never heard of (Alian, Allian, Elian... who knows the jerk wouldn't even spell it for me so I could look into it.) for "adult entertainment software" when I asked him what it was for, wanting more specific information he accused me of being too stupid to understand him and again refused to provide me with any details. I believe this is a fraudulent charge but the representative refuses to provide me with any information. After repeatedly calling them back I finally got them to transfer me to a supervisor, but the supervisor never picked up and after half an hour of listening to their hold music (it's not that bad, but it's on a 30 second loop... enough to drive anyone insane) I gave up. They've threatened to ruin my credit, threatened to call the police for harassment because I had the nerve to call back each time he hung up on me. So, any advice on how to deal with this and dispute the charges would be appreciated.

Hi krikkit,

Welcome to the forums. If this is a collection agency, then you will need to send a debt validation request to them via certified mail with return receipt requested. This way you will have proof that they received the letter. If this is a CA, then they should send you a letter within five days of the phone conversation. This doesn't always happen. It sounds like you may not get one after describing the circumstances of your phone conversation. You can find the letter in the Do it yourself section of the forum. You may able to track down their address by doing a search on the BBB website. Also keep everything documented from your phone conversations with them. You can always file a complaint with the Federal Trade Commission and your states Attorney General's office. I would say go ahead and do so with the way they treated you today.

Thanks for the advice... I've managed to track down some more information about the companies involved. According to the BBB 1st credit is a collections agency. I'm not familiar with the lingo here so I'm assuming by CA above you meant Collections Attorney? so by my understanding I will need to send them the debt validation request.

I also found several complaints on ripoffreport.com about 1st credit some specifically mentioning Alyon Technologies. (Now I know how to spell it! No thanks to the jerk on the phone.) Strangely, Alyon has 6 listings at the BBB, 3 in NJ, 2 in GA, and 1 in Chicago right across the hall from 1st Credit. (Suites 220 and 220B in the same building.) And the BBB lists Alyon's website as 1stcofa.com

The NJ listings contain information on several legal actions by state AG's regarding Alyon's fraudulent billing practices around the time of the alleged debt.

So I have filed a complaint with the BBB and will be following up with complaints to the FTC and AG against both 1st Credit and Alyon (if I can ever figure out exactly which Alyon it was, although I doubt it matters since I believe 1st Credit and all 6 Alyons are essentially the same entity.)

All in all, I'm feeling much better about the situation, although I'm still scared about the damage they could do to my credit but I'd rather spend the money on fighting them then paying them off to go away.
