I sent a debt validation letter to a creditor return receipt requested. They did not respond. Now 60 days later they sent a letter to me stating that i owe this debt and if I do not request validation within 30 days they will assume that this debt is valid. Since they did not respond to my request within thirty days should i inform them they are in violation and that I do not have to pay the debt because they did not respond in 30 days so I am assuming that the debt is not valid.

Yes, the collection agency is required to provide validation to you within 30 days after you sent letter to them.

If they have claimed for your debt reversing to what you did to them 30 days back, you must be having the copy of the return receipt. It is your proof that you made the effort to pay the debt by asking for validation.

Your side is much stronger and you can file a case against them. If they do not appear in the court, you will win the case by default.

So, consult your attorney and move ahead in the legal way. Do not let your consumer rights oppressed by such acts of the collection agency.

Thanks Ben. I contacted the attorney general's office this morning to reported them for damaging my credit reports by reporting an accout that is not mine. I received the creditor letter after I called the attorney general office.I have my letter and the return receipt dated May 21, 2005. They also verified the debt with the credit reporting agency without validating it with me first. And they did not report the debt as being disputed with the credit reporting agencies. Can I take them to small claims court without an attorney?
