westbury ventures sent an email after putting a C&D

I recieved this email after I sent a cease and desists letter. I already paid the principal amount and they aren't even licensed in my state:



Quote their sentence

Quote:

Borrowing money and intentionally neglecting to repay what was loaned to you is a serious matter.


Say that you have already paid the principal amount after looking through your bank statements and they are trying to misrepresent it.

You would have paid the interests and fees if they are licensed in your state. You have confirmed the info with the Dept of Corp and found that their business is unlicensed in your state. Add further that you are going to file your complaints with the local AG and the BBB for charging excessive interests and fees without having a valid license. It will be good if they provide a PIF letter and mark you with a "Do not loan" status in their system. Tell them that you want a response within one day or you are looking forward to file your complaints with the legal authorities.

Make sure that you are confirmed of everything before writing this letter.

A cease and desist does not prohibit a creditor or collector from contacting you via written communication. They have to have some open avenue to communicate with you.

That said, have you overpaid the principal by an amount that exceeds what is allowable by your state lending laws?

So i would only pay the remaining of the original loan. They aren't even licensed in your state also they aze charging really high interest rates which are illegal. I wouldn;t worry about it until he contacts you. They can be tough but hold you ground. You may want to report to your AG.

who is west bury ventures they just called me who is that company who are they associated with? they are very nasty, i just talked to them breifly,but i dont know who they are. maybe they are using a alias name that is why i dont know who they are, do any one know who this group is. who are they assocaiated with. and are they appart of mte or what /? i want to know so when i talk them i will know what to say to them./

do you know who the alias names are because i dont know who they are. that will help if i knew who they are they calling on behalf of whom ever the alias company is. and are they legal who ever they are i really need to know this before i call if so what should i do with these companies? i would appreciate you input thanking you in advance.

oh now i know who they are i have xpress cash an d genova roth are they easy to work with or they mean i am tring to work with these people but its there way or no way i dont understand. at least i know who they are they just say westbury ventures what are they email address if you dont main tell me this. i forgot what i go i will go back to see are they legal do you know i know that in the state of ill a pay day loan cannot take more 15 per 100 they all take more than that, also they cannot do crimanal charges so these threats are just to scare people of course who wants to go to jail no one if they can keep from it. so who have advice for these people:? also national opportunty i dont know if this is there real name but that is the name they give me when they call.

I am in process of fighting with Westbury Ventures. I applied for a loan and then didn't need it. I never received the money but they took it out of my accoutn!!!! what do i do?

Westbury claims to be a debt buyer and that the fdcpa doesn't apply when you own the debt. But the FDCPA is clear. Unless you buy the debt BEFORE it goes into default you are no different from a collection agency, at least for purposes of a lawsuit under the FDCPA.
