Make the creditor provide you proof of this debt. If it's not legitimate, it should not be listed in your credit report. Like you said, this item is already disputed and removed from your credit report. Is the creditor reporting it again in your credit copy?
As per the FCRA laws, re-inserting inaccurate negative info without proof is violation of the FCRA under Section 623. Sue them up to $1,000

Well as I see it your taking the right steps to getting the matter cleared up.The companies do not always validate when asked to. I would wait about 2 months and if you dont hear back from them send a second letter with a copy of the original letter you sent them.
I'm a little confused on your post though. Is the collector you sent the dv letter to the same one that you had disputed?If so was it taken off you cr then reinserted or never taken off at all?
Also I dont really see how this ONE little issue would hurt your credit that much.Now if you had a bunch on your report then that would hurt your credit.Have you applied for credit and been turned down and think possibly this one derogatory entry is why?

Yes, I did think it was that entry giving me a bad credit standing because they were listing three different times on each report. So, it appeared that I had three bad accounts.
Currently, there is nothing on my credit reports in the nagative. I sent the letter anyway just to get these people off my back. I want them to stop calling my wife and I making excuses why I should pay a debt I never owed them! I tell them I paid the original debtor, they ask me to send proof. I tell them I don't keep records beyond the statute of limitations and they tell me that I am still "morally" obligated to pay them.

Have you pulled your credit report, you can go to annualcreditreport.com and pull a free copy once a year to monitor your progress, you can also track your creditors. It won't give you a credit score but it will show you your entire credit history. I found it very useful, haven't got quite everything cleaned up yet, but I am getting there. Don't fall for the gimmick credit cards that promise to help rebuild your credit, they often have fees and overhead that gets you even further in the whole. Goodluck and stick with this website, these folks have help me out so much. They have supported me and encouraged me to take the right steps. I got here throught the payday lending nightmare, oh yeah-- stay away from them too. You made a wise decision to come here, goodluck and we are all here to support you.

You can also send out a cease and desist letter to this company telling them you do not want amy communication from them other then written correspondance to get the calls to stop.

Thank you all for your support. I have been reading this forum for awhile before joining. I knew there would be a lot of people who could help out! Thank you.
I did get the reports from annualreport.com. I did that after disputing the entries. Once that was cleared up, I got the reports just for peace of mind. However, when I was told that I still had a negative on my name, I had to re-check by paying for the 3-in-1 report to make sure they were not putting the entries back. It would be nice to be able to monitor them for free. But for now you can only look for free once a year.
Regarding the letter I sent them, it did have a request for a cease and desist on it. I'm still waiting for a delivery confirmation on that as it was sent certified with return receipt. (Advice I found here!) Thanks again for everything, and I will keep everyone updated as to the turn out of this issue! :)
