Files leave my office after charge off and the client then sued her for the full balance. She called in ready to pay the balance in full crying about the judgement. I explained to her that there was nothing I can do and she must deal directly with the clients attorny now.
Please don't avoid your debts if you can afford to pay them or have assets to help you negotiate. If they are in collections and you know for 100% fact they are yours don't refuse to pay just because it went to collections.

I am a debtor myself, however I am refering to someone whom I had had contact at my place of employment because she owed a debt to my employers client.
There is no shame in being a debtor as long as you are trying to resolve the debt.

If only we could choose our collectors. Even for my own debts I have been fairly lucky and when I'm not I just keep calling them back until I find one I want to deal with who won't teat me like I am a scum bag and take the time to explain everything I want to know.

FYI, I see you in the shoes of a 'debtor' as well as a 'debt collector'. You know more because you see things from both points. I hope it's not tough for you to understand someone who has sold off everything just to pay his debts but still can't manage to do. What will be your advice for that person when the collectors keep bugging him? You may have been little considerate to that person if you were collecting from him but how should s/he deal with the rude collector? Imagine the situation when one has no money to serve food in the table, filing for bankruptcy is just too far. Filing legal complaints is a lengthy process. The rude collectors don't stop just by knocking to the legal places. It takes time. Unfortunately, there are some companies that are still in business even after hundreds of complaints are filed everyday, and they are well aware of it.

How to deal with a rude collector? If it was me I would tell them I don't appreciate they way they are talking to me and to call me next time with a better attitude and hang up. I might also write a letter to the company explaining my situation as well as to my creditor. I wouldn't ignore the calls, I just wouldn't answer every single one of them. Caller ID and an answering machine lets you pick and choose who you want to talk to and when you want to talk to them. Utilize it.
If a person has no money to even provide for their basic needs then it's time to take a job that you would normaly overlook. Fast food, retail, janitorial services, collections, school bus driver.
Also investigate human resources in your city for foodstamps, money support, medical insurance. Also go to your church you don't even have to be a member to apply for help to pay the bills like electric, water, rent. I know the economy sucks. Even worse for some of the northern states but even if it is shoveling snow or moving lawns or becoming a child care provider there are things that can be done. You just have to look outside of what you want for what you need and actualy take the step.

I think that is very good advice. I have done so with some of the rude collectors that have contacted me recently. I have documented parts of the calls in the dv letter that I sent the CA. I haven't heard back from them yet.
