I have a capital one card that I haven’t paid due to some financial problems... any way, i got a call from Gerald E. Morre and associates saying that I had to pay or they would take me to court. This took place on a Saturday, I told them that i would need to call them back during the week so i could get some money together. The representative told me he would need my debit card number in order not to start legation against me. Being a good citizen and wanting to get the matter resolved or the stupidest guy in the planet I gave him the number with the understanding that no money was to come out of my account. I know.... Lesson learned. So today i check my account and they had charged the full amount out of my checking account with out permission. Now my checking account is negative. I went to my bank and told them that it was a fraudulent transaction. I don’t known what else to do with this... any ideas????

Since you never authorized the collector to withdraw funds from your account, report them to your attorney general. File a dispute with your bank also. They may be able to revert the transaction. Get every proof of your actions in case, you want to pursue legal actions against the collection agency.

Call the collection agency and verify the debt in writing. They must validate following the FDCPA. Or else, sue them for doing fraudulent activities on your account.

Just a thought.. NEVER give banking info to anyone on the phone.. If they have called you.. you have no idea who is on the other end of the line.. that is first and if you choose to give them the info ask for the phone number and call back,, Never offer ss# or Bank Info.. I wouldnt even confirm the info.. that is the way ID theft is generated..
be careful.. we all send enough when we started by sending banking info over the internet when we took the IPDL.. I have been lucky so far no one has touched my acct. even when I put a stopped for MCN from taking funds.. But please be careful. And a legit company wouldnt ask you to give them this info..
Just my .02...

Here is a good one for all of you. I recently was contacted by this company as well. I paid them the first installment and then they charged me for OTHER's bills into my account. Granted it is not much that I lost, but they sent checks written off of other banks, made out to them, and signed by people I do not know. THIS IS FRAUD and I am now looking into something that can be done about this.
