credit card debt

I set up payment arrangements with them. It is from an old credit card probably 7 years ago or more. They said they were investagators or something. If I did not set up arrangements they would garnish. They told me how my credit was not that bad. They said they would send me all this info to get help on my credit. I did not get anything from them. I did not have the money to make the last payment so I entered a stop payment because last time I called I did not get a call back. Once they got the stop payment they said I passed a bad check across state line and it is a federal offense. Is that a felony? I did not write a check I tried to stop it so they said they will contact my HR to start the garnishment.

First question: has this company verified the debt with you? From what you say, I even question if the SOL of the debt is passed.

And that statement about federal offense....yeah - that was a lie. They hope to garnish you wages to guarantee they make money off you. What kind of debt verification have they sent you? Or have then done everything over the phone.

Also - what is the name of these "investigators"?

Welcome to the Community :D Jedijeff is right, you need to get this properly validated. Just sending you a paper with what you owe isn't full validation. They will threaten any and everything. Keep notes on names they give you, dates they call, and all correspondence you,or they send. Next time tell them you need badge numbers, since they are deputies :lol: if they refuse,which they will, you know they are blowing smoke!!..Karen

Collection agency is passing hot smoke. You don't need to be worried about them. Just confirm when you did the last payment? It looks like it's already past the SOL. They cannot sue you in that case. Moreover, if the account is 7 years old, it's close to be getting removed from your credit report. A small payment will bring it into activity and the reporting will continue in your credit file. If you make a partial payment now and miss the remaining balance, companies will get a case against you since the SOL is already renewed from the last payment date.

Garnishment cannot happen without a court order. You will be served summon to appear in the court and present your case. The judge will decide if a judgment is needed to be filed against you. But with the SOL already expired, the case is in your favor.

SOL gets renewed from the latest payment date. Call the original company and try to work out some arrangements with them. They will be a lot easier dealing with instead of working with any collection agency. Most of the times, the CAs violate the federal and state laws and produce accounts in disputed shape.
