Date: Wed, 01/31/2007 - 17:08
1. When we get married, can they garnish my checks for her debt?
2. When she stops working to take care of the baby, what can the credit agencies do to her and/or me for the debt she aquired before we got married?
Thank you so much for any help.
Welcome!! No, you can't and won't be garnished for her debt.
Welcome!!
No, you can't and won't be garnished for her debt. It would be in her best interest to find out the balance on the judgement and make some arrangements for after she stops working though...Otherwise it can get very ugly, and the fees will rack up like you wouldn't believe. And...Theoretically they COULD levvy bank accounts..I'm assuming they will be combined?
As far as collecting..If she doesn't work they can't garnish her, but once again you run the risk of accounts being seized. My advice to you is to look into a consolidation plan..A professional counselor will call you since you've registered, they can give you advice on different options. Good luck.

Actually, no. I will have my checking account only. She owns her car without any loan attatched to it. I am wondering, just what can they do to her after she stops working? Will they eventually just write that debt off? She won't be working, so what can they really do? There is not debtors prison anymore is there?

No, there is not debtors' prison. Although some CAs threaten people with arrest, which is an illegal collection tactic. If she isn't working then there isn't any check to garnish, but once she starts working again they could garnish the check.

What state are you in? Some states allow other methods for collecting on judgements, the can freeze bank accounts, force the sale of property, etc . . . . If you post what state you are in I can tell you exactly what they are allowed to do . . . .
