Welcome to the Community :D If you have received a summons, you need to reply to it within the time frame on the summons. The SOL starts when the last activity is on the account. If you made a payment in 2004 on the account, it would re-start the SOL, if I'm not mistaken. Send the attorney,whose collecting on this a debt validation letter,it may be too late, but it won't hurt. The important thing is that you respond in writing, and show up for the hearing. If you don't, they will grant an automatic judgement. Sometimes in your response you can put that this would cause a hardship financially for you. In some cases, they will adjust payments . First, find out whether your last payment of $75 was posted towards this account. Since you said you never had a MasterCard account, the collection agency needs to prove in their debt validation request that your $75 payment went into this account. If this isn't done, you will easily prove in the court that you never had the account and the CA has failed to validate the account. Do all communication in writing for proof. File your papers to show up in the court.
