Mike, I received notification on 2/5/2007 that in order to proceed with the settlement process nedeed to remove all postings from this or any other public website or public forums which reference, directly or indirectly, our offer to settle.

I am a little confused on your settlement company making such a request. You haven't posted anything about the company. You were just discussing about your personal debt problems.

You still haven't signed the contract with them. Even if their name comes out, why would they want your posts to be removed from any public forum/website. Can you please get their point clarified? I want you to be in safe hands.

Boy, that's weird. I've never heard of a debt consolidation or settlement company making such a statement. Keep us posted.

I am afraid that I did mentioned this company in two maybe 3 postings, I got so excited that another pdl was going to refund some of the overpayment and mark my loan "paid in full". At the same time that I did the postings I had to sign a release in which it states that I could not talk or post any info regarding this company. Now, I have one ?? how did they find out about the posting? they even game your website. Do you think this pdl have someone looking at the website all 24 hrs?

Mollie I have got the same type of settlement letters and you know what it is CRAP!!!! They cant stop you from speaking your mind its your first amendment rights. They are the ILLEGAL ones and thats why they dont like this website. This website has helped many many people from becoming their next victim. Best Wishes KYSIDE38

I would think if they were an honest company, they would appreciate the free advertisement. Word of mouth carries more weight than a newspaper ad.

Since freedom of speech is protected by the first amendment, to prohibit your right to freedom of speech would make that clause of the contract unconstitutional, and would thus render it "unenforceable." A court cannot enforce any breech of contract that is unconstitutional in nature.

In the least, if somehow that is a legal clause, they would have to prove that you "damaged" them somehow in your release of information.

Mollie - I got that same type of letter and I told them yah right - whatever you say just refund my money. I talk to an attorney and he said that if the money is owed to me and tha company admits that it owes me the money there should be no strings attached. As simple as that.

Not only that - how would they know that you are the one posting? You could be anyone here or on any other forum posting about them.

I would:

edit the post
pay off the loan
get the PIF letter
reedit the post back

Just my opinion. Quickest way to fix it. Hell - if you want - PM me the name of the company. When you are all complete, I'll open up the floodgates with posts about them.

Actually the one that I had wanted me to rescind all of the complaints that I made against them. How do you look credible by doing that. What I did tell them I would do and what I did was to send a copy of the check that they sent me to the FTC and the ag's office in Ohio, with the letter that they sent me telling me that the offer of a refund was based upon my rescinding all of my complaints and post here on this forum or anywhere else.

Thanks everyone, I will use some wording out of your posting and send them an email and I am going to tell them to send me my refund and I will send a copy of the check to the AGs, BBB. Let's see what happens I will keep you informed.

This is so wrong, wrong, WRONG! How can a company operating illegally anyway, have the audacity to expect someone to LISTEN to their demands? When I received a refund letter about a year ago, I got the same line of bull.

And yes, in answer to the original posters question--I believe that these illegal crooks are monintoring this site. Which is good---it shows they are running scared and don't know what to do, so they try and intimidate! :twisted: Guess again---knowledge is extremely EMPOWERING! And we "gots" it.
