depending on the bank you use, you may have to pay off what you owe first. Most banks use a system called Chexsystems - a nationwide database that most banks will check for your name & information prior to opening an account. If they see you owe money to another bank for overdrafts, or have your name flagged for fraud in Chexsystems, they will not open the account for you.
There is a list of banks available from our user, Goudah, that shows banks in your state that will open accounts without using Chexsystems. I'm sure the info might be posted here for you soon. :-)

Chexsystems is unlike some of the other tracking systems banks use. Once you are reported it will stay for 5 years. Even if the item is paid off, it will only show that it was paid. It will not be removed. There is a dispute process, so you could try and go that route and hope the bank doesn't verify the info. The only other way to be removed is for the reporting bank to remove you. This can be extremely difficult to have happen, as you have to convince the bank to do it for you.
