Help! Advice please!

HI. My husband has an outstanding student loan from about 10 years ago. 7 years ago he decleared bankruptcy, as he could not make the payments (very frustrating as it was his only debt!). The student loan debt was not forgiven and now that he is starting to earn money again a collection agency hired by the government has started to call. I called and talked with them (they are being very nice so far) and talked about options to pay beak a 10000 loan with about 4000 interest accrued over time. We can afford about 150/month to pay back. The CA told me it would take a long time (!12 years)to pay back at that rate, but I'm OK with that and other options like a loan or line of credit won't give us the same interest we are currently getting so we'd end up paying more (or would we?). I want to just pay the goverment back at that amount as it's about all we can afford. What do I do if they don't accept my offer and want the full amount? I'm scared if we go to a consolidator they'll tell use we have to pay more that 150 and I don't think we can. I don't want to let this get bad - want to deal with it now and get it out of the way, even if we're paying on it for years and years. My husband is angry at the CA after what he went through before and refuses to deal with them or pay them so I'm negotiating and we can send money to the gov't direct and get this over with.

What do we do if they won't accept our offer? What about an offer of 200/month for 5 years. It's pay off the principal debt? Do you think they'd go for that? I don't know what to do...

I can understand the situation you are in.
If you are willing to pay the money back i think the government collection agency will definitely want to arrive at a settlement with you. Then you can sit down and develop a repayment plan which suits your pocket.
The only concern for them might be the time required to pay off the debt if you pay $150 every month. So they are likely to negotiate on the amount of your monthly payment.

It is quite difficult to predict if they will agree to your offer of only paying the principle amount. But since the debt is quite old and your husband has been declared because of this debt might just help your cause.

In case, the collection agency doesn't agree to your offer you have the option of availing the services of a debt consolidation company which deals with student loans.These companies will negotiate with the agency on your behalf and can reduce the total debt amount to a large extent. They can also help reduce the interest rate, eliminate over-limit and late payment charges. So it can be quite beneficial if you get your debt consolidated with a reputed company.

Ok,
I called collectcorp and apparently the gov't of canada won't do any deals - we owe the whole amount. I don't know if this is true, but when I offered payment of 150.month until the debt is paid, they told me (never mentioned it before) that they deal in 6 month payment setups only and would accept our 150/month for the next 6 months. She sounded miffed that we'd spoken to a financial adviser. They said they weren't authorised to give us anything in writing other than standard government forms relating to full payment and that we will have to fill out a questionaire that will come in the mail to us about our finances so they can "justify why they are accepting this amount" to the government. We can send off 6 months worth of checks to the reciever general of the government, but in 6 months (or maybe sooner) we may be back in the same boat. I am leery that we send them a whole bunch of information and they get money from us but we have absolutely no guarantee that things will not be changed immediately on their whim. I am not feeling the relief I though I would when they said we would send them payments and they accepted. She said nothing to us on the phone about the 6 month terms when we spoke before.
Is it true they can't give us anything in writing? What stops them from changing the deal at any time? 150/month for the next 12.75 years is something I can live with (I had long terms on my student loans too, but my payments are fixed the whole time). If my husbands work improves they are going to ask for more money. I don't want to give them anymore than this. Neither does my husband ( I realise that it's our fault we're in this mess but we are trying to get our lives together and are finally starting to - we don't need this when we're trying to fix things). As it is we aren't sending the money to Collectcorp but to the government, as I refuse to pay them directly (they weren't impressed with this but said we could do it although we could "expect delays". The Checks aremade out to the Director General anyways so it shouldn't matter who it goes to as long as they get the money. The number they gave me to get the address to send the money is an old number and I have to get the new address tommorrow as the office now closed. I am worried when I call the office tommorrow I'll be told it was a lie and I have to pay CollectCorp. I feel like I"m being jerked around.
Thay also told me that going to a gredit consolidator for a loan will give us an R7 on our credit rating (which apparently is bad). Seeing as his credit is already screwed I really don't see how this is supposed to scare us. Is that true? Do they just not want us dealing with a financial person as they'll get screwed over?
I am feeling like a toy that is being batted around at the whim of people who hold power over my life and I am not enjoying it. Advice about what to do next would be appreciated. I don't want to redo this stress every 6 months.

I read your problem and feel that this is something that is very tough to handle. As long as we are willing to pay our debt, why should there be so many problems from the end of the creditors, collectors and stuff like that.

I was relieved when I took the help of the counseling program with this company. The consultant efficiently dealt with all of my problems and I was left with no worries at all.
