I just arrived home, Satuday 2/10 to find a summons stuck between my door with the top cover torn off....suing me for 1700+ for an AT&T bill. I sent them a dispute letter but never heard back....what scares me it says I have 20 days after date of service to answer the complaint...THEY dated it 12/29/06 and the county clerk stamped it 1/8/07 (how convenient I get this 30 days later)...like I said the top is torn so I don't know what date they put or if they signed my name. I am scared my bank account will be frozen. Someone please help!


Often a suit will be filed and the plaintiff will not send a process server to pick it up and deliver it until many days later. The date that matters is the date the process server states you were served with notice. Like cajunbulldog said, contact the court to find out when your answer is really due.

Don't be afraid to look for a lawyer who knows the fdcpa. If you get a lawyer to bring a counterclaim, you might be able to reach a reasonable settlement.
