If it is passed 7 yrs and all collections have come off...

My credit is finally getting back to good after having to wait 7 years for a couple things to clear. However, this year (after seeing no collection agencies on my report a month ago)I received a letter in the mail from an agency trying to collect a debt that is from atleast 7 years ago on the original credit card. Are they allowed to add this to my credit causing a bad reflection on my credit now? I mean it is originally past the 7 years but it is a new agency that bought the debt. Do they have the right to add this on my credit report? If so, should I send a ceast and desist letter to them?


There are numerous views on payment of old debt. The Fair Credit Reporting Act states under negative reporting that creditors can only report 7 years from date of first delinquency. If debt is that old,it should be out of statute for reporting or for sueing. Send a full cease and desist letter and move on to next order of business in my opinion.

Did you know most states have a statute of limitations on debt collection? (In most states it is 3-6 years from date of last payment they received from you) It IS NOT the same time frame as the length of time a negative remark can stay on your credit report.( 7-10 years)
