WI - CashNetUSA help
Date: Wed, 02/14/2007 - 18:09
I just registered here and I realize i should have done that sooner, but I guess the larger mistake I made is taking out A PDL. Anyways, here is my problem:
In September I took out an $1100 payday loan with cashnetusa.com. When I started this I did not realize that NONE of the finance charge would ever count towards the principal. So when i roll this loan over the maximum 4 times and pay the loan, I have paid $2475. So, to make a long story short, I can't do this anymore. I am out of extensions and I certainly do not have $1375 sitting around ( i've already given it to them). I have seen a lot of information and advice about how to deal with this on this site, but not much with Wisconsin specifically.
Any help at all is appreciated...
Thank You,
jason

I have been in your shoes many of times and I am still digging myself out of the payday loan trap. WI doesn't really have any laws for payday lenders except how much they can charge you for a nsf check and that your check is not worthless. What happened to me is my bank closed my account so everything went back nsf, account closed now I am dealing with collection agencys. I really don't know about cashnet but I would call them and let them know your situation and they may just send the check through and as soon as they get it back you may be able to make arrangements with them to pay it. One of my IPDL's let me do that and they didn't tack on any extra interest only a nsf fee and let me pay it in a couple of payments. If they won't work with you file a complant with WI AG. Thanks for your quick reply. One thing I noticed on the Wisconsin State Info site about PDL's right after that $15 NSF; Check Presentment Limit: two times.
What exactly does that mean?

That means your check cannot be presented to the bank more than twice. If it is returned for NSF the first time, they can present it once more. If it's returned NSF the second time, then they have to find another way to get their money.

That's right. I just found out yesterday from I-Collect that platinum B tried to present my check 12 times and they not only charged me $30 nsf each time but they also tacked on another $105 service charge each time they tried to collect. So I told her what the law was in my state and she said that didn't matter. So she said that the $875.10 is way cheaper than what they should be collecting from me. So I just put in another e-mail to Kathleen Hanna to let her know this info. So I am sure she is going to love that they presented my check 12 times.

Ok, how about this (it's in my loan agreement):
"The ECheck/ACH Authorizations set forth in this Loan Agreement are to remain in full force and effect for this transaction until your indebtedness to us for the Total of Payments, plus any fee incurred, is fully satisfied. You may only revoke the above authorizations by contacting us directly, and only after you have satisfied your indebtedness to us"
Does this mean I can't email them revoking authorization? Also, i assume some of the replies here are Wisconsinites...what kind of luck have you had setting up payment plans, since we do not seem to have any laws?

Oh yeah, and the second time they presented my check (after the first was NSF), they broke it up into two amounts and tried two debits. Does that count as three total?

well I talked to kathleen and when I told her about the 12 times I told her that I had bank statements to prove it. Now I have to send her copies of it. They tried to take out of my account 3 times in 1 day. SHe said that was a no no.
I don't know about the ach thing. But hey I guess it wouldn't hurt but I would also mail them a copy but send it certified mail with return receipt requested so you know they got it. I would also give one to your bank so they have it on file. Make sure you keep one for your records also. ( I have a pretty big file going on here I may have to break out another one because this one is getting full of copies of this and that)
I would file a complaint with Kathleen also. When you file a complaint and you get a case number back from her, you can e-mail her all of your copies of everything you have including your agreement, bank statements that show the withdrawls, e-mails you have from them any and all paper trail you have on these people. Plus if you went looking for the loan or if you got an unsolicited (sp?) e-mail from them. Because if you answered an e-mail then they have to be licensed in the state.
good luck
