Has anyone ever gotten a legit "validation" from collection agencies? I have 1 time for an old debt that I paid years ago after my divorce. I certainly havent seen any from

Bass and Associates

I have called one today to get a letter and they said to give them 5 minutes. I gave them an hour and they say the printer is jammed and they will get it to me ASAP. That has been 3 hours ago and I am still waiting.

Per the FDCPA:

Within five days after you are first contacted, the collector must send you a written notice telling you the amount of money you owe; the name of the creditor to whom you owe the money; and what action to take if you believe you do not owe the money.

Contact you AG and file a complaint. You also may want to ask your AG if the debt collector is required to be licensed in your state, and if they are required, ask them to verify that the creditor you are speaking with is licensed. While they may not be fast is taking care of fdcpa violations, AG's love unlicensed businesses. Slam dunk fines.

I feel that is the reason many will NOT validate debt. Sending you a letter with their letterhead on it and you address proves they are trying to collect a debt. The AG having that letter in their hand is a cut and dry win in an unlicensed business court case.

When any company is not responding to you with the debt information, they are clearly going against the fdcpa and FCRA laws. It is clearly specified in the laws that when you request for the needful information about the debt, the company has to give you the copy of the agreement and statement. If they don't show this to you, report them to the Office of Thrift Supervision, Federal Trade Commission, Office of Controller Currency and the Attorney General's office. The investigation process will begin on the company on the basis of your complaints.
