Can I be arrested in Texas for not paying Payday rollover pa

In Texas can I go to jail for hot checks if I stop paying the Payday loan roll-over payments every two weeks...they ar now more than I make and I have to make a new loan just to keep paying. I am sinking so fast it is frightening. They tell me I will be arrested for hot checks. I had to take out payday loans just to pay the interest. I am single mom with three kids..a decent job but I can no longer pay Payday payments and pay rent food, child care and car payments. Husband is gone and does not offer any child care help!I don want to default but I am at the very end of my rope. I cant borrow from a bank or I would have in the first place!


No, they can't arrest you. They might like to make you think they can, but they can't. Read through this site, there is some great advice posted. you are liekly going to have to default on the loans and then work out payment arrangements. There are some PDL consolidation places ut there-- you could look into that.

Welcome to the forum. Who is telling you that you will go to jail? Now take a deep breath and can you give us a little more info. How many pdls do you have? Are they store front or internet? We have all been or are in the same position that you are in so you are not alone. I know that there are a few members who are from Texas and since you registered you will get a free call from a debt counselor.

Criminal actions are actually not specified in Texas. The loan companies cannot send you to jail for writing a bad check, but if they are able to prove that you were intentionally avoiding the payments and writing bad checks just because of this reason, they will get a case against you. Better move is to make payment arrangements with them and show every intention to repay the loan. Enroll into some debt management plan if that solves the existing problems.

I have six PDL's and they are all storefront. Five of the six were taken to keep paying the interest payments. I have already paid more in interest than the original loans. I just cannot pay them anymore without taking out more loans and that will be the end of me!
The "Arrest for hot checks" comes from internet stories in Dallas county! Supposedly a DA did prosecute a lady for this very thing but I do not know that to be fact. But it scare me for myself, my job and my two and three year old! I have never missed a payment and this has been going on for nearly a year!

I will be more cautious if it????????s a storefront lender, because most of them follow the laws.

Know the laws in your state and review the contract signed by your lenders. You should be able to figure out if there are any excessive charges added on your account by the companies.

Thanks to a everyone who responded to my question. I am encouraged just to know there are others who have dealt with this and survived. I am searching for an attorney with hopes of having leagal guidance before I make an even bigger mistake. I want to get this finished but I want to do it the right way. Your input has given me hope! I still cannot find any information about PDL consolidation yet but I will keep looking!

I don't know about texas but in WI most of the store front pdl will work with a debt consolidation. Don't feel bad because I had to do the same thing. I have 6 store front pdl's. I have worked out arrangements with the companies myself. But I know some storefronts won't do that. I guess I just got lucky. If you call the store front lenders let them know your situation and if you still can't work out an agreement try calling corporate. Sometimes you can get info there. You may have to let them deposit your check and let it go back nsf. DO NOT stop payment on the check because then it WILL look bad. I had a pdl tell me that it is best to have it come back as nsf than stop payment. When you call find out what your options are if the check comes back nsf and you don't have the funds to pay in full.
