I have found out that this is a legal practice if they are calling you. I have set up a fax modem on an old computer to record every incoming phone call with a date and time stamp on it. So once the phone starts ringing it is recorded. This is legal due to the message that is at the start of their calls to you. Most of the time it goes something like this. "All calls are monitored or recorded for quality service yadda yadda yadda" So the CA knows that they are being recorded already. You do NOT have to inform them that you are recording the call. Just make sure that when you record the call that you get that message at the very beginning.

So now you have more ammo on your side.


YAY! In most states, the recording is legal if it????????s done secretly without notifying the other party. In some states, you have to take the permission of one party. No matter, if it????????s said verbally or by an automated machine, they should be made clear of your intentions. I believe you will be safer if it????????s clearly specified that the call is going to be used for legal purpose, if needed. This way, the other party will have no reasons to get misled.

Steg, I agree with you 100% you should tell them too. But as long as that message is there at the begining and you stay on the phone then you are giving the permission to be recorded. As for the other end they already know that they are being recorded (by their company) so they think that they are safe and can do anything cause the company can just say that they were not recording at that time. So this is just another option for some to use.
