Sorry I don't know who RJM is but when you sent the DV to them did you send it cert. mail with return reciept requested? That way you would have known when they recieved it. Do you have proof that you sent the letter? If you read the posts in here most of them will tell you what you need to send and how, they also tell you to file a complaint to the AG if they did something wrong. I am sorry that this happened to you. But you need to show up for the court date if the company will not settle outside of court. But I believe that if they have yet to validate the debt and you have proof you need to bring that to court with you. If you have any questions before court most lawyers will give some advise over the phone for free. All you have to do is tell them what you have done and what the other company said and they will tell you which way to go. I am sure there are other members that will give you some great advise on how to handle this situation. So keep an eye out for it.

This is a common threat collectors pull to scare people.First by filing without validating,they are in violation of federal law.First file complaint with bbb,ag,and ftc. Next,go to www.naca.net and look for a referral close to you. Lastly,attorney or not show up for court and explain to court that they have broke the law by failing to validate. A good attorney will probably put some cross claims in your answer to countersue for fdcpa violations.
