Hi all,
I received a letter from Thomas J. Russell Attorney at Law the other day regarding an overdue account with one of my wife's accounts from Ginny's. He states that he is representing them and is asking for payment of the amount due which is $968.15. The account is approx. 6-7 months without payments. This attorney is legit, he is in PA and I am in CA. I researched him online and he is a single lawyer with no other employees. What do you think are the chances that this lawyer could actually file a suit against my wife considering the fact that he practices in another state far away? Could he transfer this to another lawyer he may be affiliated with in my state? If so, does he also have to send me a letter and follow up according to the fdcpa?

In any event, I will be sending a validation letter via certified mail (Return Receipt) before the 30 days for validation is up.

Any comments or suggestions welcome.


I am also dealing with them now on a different credit account that was listed with my debt settlement company. Yes, he does have to follow the fdcpa. I'm in Ohio and the first phone call I got from one of his aids was absolutely ridiculous. The debt was less than five hundred dollars at the time. Even less now because I have paid the original creditor on this. It took them two months to validate the debt per my request. What they sent me was illegible print screens so I am sending another letter to dispute the debt again. Also the amounts did not match my records so that is another reason that I am disputing it. As far as a law suit, I'm not sure how they work on that. I was threatened on the first phone call and nothing has happened yet. This has been going on since November of last year. I would get the DV letter on ASAP.

I just recieved a letter from him from Ginnys for an overdue amount of 100 dollars. Jesus just 100 bucks lol. :roll:

I just received a phone call from someone at this office about an overdue account with Fashion Bug. I don't dispute the fact of the over due account but the amount requested is very high (exceeds the credit limit by $300!) The person form the law office said a letter was sent to me but I haven't received it. When I requested a copy of the letter, he said that once I received it, I had to call him and pay the amount requested by phone and that there would be no alternate terms offered. I told him that I would pay by mailing him a check and he told me that I was stalling and subject to legal action. Is this true?

Alot of them will tell you that is the only way to pay just to put pressure on you. I have had some say that, I sent them a money order(make a copy of it) and they have never sent money back saying they won't accept it!

They should tell you in the letter how they came up with that amount, interest, charges, etc. Feel free to ask questions..karen

I received several calls from a Betty in his office telling me that my lawyer had to contact them immediately regarding my law suit. I don't have a law suit nor have I been notified of a law suit. SO, I am taking the information to my local District Attorney's office and try to file fraud.
NEVER send any money to any collector or attorney! ALWAYS deal directly with the company and the bank behind the company. They will negotiate a past due account in your favor, usually.
I'm in California. Fashion Bug has put a hundred pieces of jewelry on my card that was paid off and canceled a year ago.
I'm going after the bank for harassment and fraud.

I too received a call from a Tom King at this Thomas J. Russell Law firm. I have not called back yet, because I am at the beginning of filing for bankruptcy. I have completed my Credit Counseling and have my appointment to give the bankruptcy attorney the money to file on Tuesday of next week. So I am a little reluctant to call him. Not sure if I should let my attorney do it. I'm not sure how quickly this other attorney (Tom King) can do anything to me.
