Finally got a bill today in the amount of 876.55. I want to negotiate this as the original credit limit was 500. What should my next step be? Di I have to do the dv letter or can I start trying to negotiate now?


There are a couple options available. You could send your letter to the collector and wait for validation.Since this is Cap 1,they should have no problems getting records because Cap 1 keeps them forever. I would suggest calling and feeling them out so you can settle with the original creditor and leave the collector out of the picture.

I sent a validation letter to a third party collector for cap one and they responded saying they sent the account back to the creditor. All I can advise is, if legal in your state, record every call with them. In my experience, EVERY collector violates the law. And in every violation you have the opportunity to recovery money damages and/or get the debt forgiven/zeroed out. Whatever you do, stand strong and don't take their crap. Know your rights and assert them.
