Just got off the phone with the mortgage company and am now so upset! I am now at the end of my rope. I need to come up with another $1500 to keep the mortgage company from starting Foreclosure proceedings! Said we would be getting a notice within the next 30 days unless we pay the total due. The total amount we need is $3000, so we are going to be able to come up with 1/2 of that this month, but we can't come up with the other 1/2, due to having to make our car payment, utilities, school stuff, etc. I don't have no idea where to turn, what to do or anything. The mortage company said they can't work out a repayment plan due to us "making too much money". If I don't pay anything else and let the power go off and let my car be repoed and not buy groceries, or car gas, which is now almost $2.50 per gallon etc, I can come up with the money, but these things need to be taken care of too! I have called my folks and they don't have it, my husband's mom can't help and my brother has his own mess he is dealing with, we have already tried getting a small loan and was told no due to credit and just don't know what to do!!! I have been on the phone for the last hour or so trying to see if we can come up with the money. Finally got all our information to file our taxes, but to be honest, have not idea how they are going to turn out. I am just sick right now! I just don't know what to do! Can anyone help??? I am just sick now!


I feel for you 2nband. I am in the same boat myself. Just got a Notice of sale letter yesterday. everything seems pretty hopeless right now. i am going to check into chapter 13 first thing in the morning. i am so tired of living like this. If I come up with any solutions, I will let you know about this. My thoughts are with you!!

Not that it would get you very close, but some car loans allow you to defer a payment, skipping one month, and adding one payment to the end of the loan. I've heard that you can do this either once a year, or once during the life of the loan. Whatever the case, I hope you will be able to keep your house, I was once evicted, but I can't imagine what it would be like to lose a home.

We can't file bankruptcy because ours is less than 3 years old. I just got all our tax stuff together and my husband has already got a call into the lady that does our taxes so we can get them done next week. Not sure how long it would take to have the funds direct deposited into our account (she does do them electronically), so hopefully it won't take long. She does not work for any of the large companies, (H&R Block or any of those), she works out of her house. She use to work for a company and decided to do it herself, plus she isn't very expensive either. I used the H&R block calculator and it showed that we should get over $2000 back, (I hope) and that would help get us caught up! Keep your finders crossed for us that all this can be done within the next couple of weeks!!!

Oh, they are sending us a "Loss Mitigation Packed", whatever that is. Said we needed to fill that out and send it back to them as soon as possible. Not sure what that is for, but will see when we get it in about 5 days. I am just so upset because we had been working so hard to get things back on track and were starting to and then boom!!! The guy I talked to today was real snotty about things though. When I explained to him how we ended up this way, he just made the comment that "we were adults and should have known better and put our priorities straight". Really ticked me off and didn't help make me feel any better. IN fact it really made me feel stupid! Sorry for ranting, but just a little upset right now. Forgive me.

When I did my taxes, I e-filed, and it took 6 days to my state, and 9 days to get my federal refund. I hope yours are as timely or better.

I understand a loss mitigation packet to be some sort of repayment agreement, I think it is a plan you submit to stave off foreclosure.

Thanks Morningstar! I appreciate that. Just got to get that faith up a little more and turn things over to the "big guy" upstairs, but boy it sure is hard not to worry about it. These damn PDL's really screwed everything up for us. Never ever again will I do something so stupid as take out a payday loan!

2nband, You can go onto TurboTax and it walks you right through your taxes and you can do it 24/7. It is also on the site for the IRS. The cost is about 70.00 for everything. That is the cost of TurboTax, and the fee that the bank that they use to funnel the retuns to and they filed my state taxes for free. You have all of the money within 15 days. Give it a shot. You could get it in today and by tomorrow you will know if the IRS accepts it. TurboTax even checks for errors.

Irish ~ That is what our tax lady charges to do all our taxes. We talked to her and she will file them electronically. I just hate messing with it and have never been good at doing the taxes and we have deductions and such, so.... My husband has an appointment with her at 9:00 tomorrow morning, right after he goes to the bank.

Just made up my mind for the rest of the night I was not going to worry about anything but enjoy my family being home all together, which isn't very often, and then see what happens tomorrow. Well, that is the plan anyway. I am sure I will be taking something to help me sleep tonight or I will be tossing and turning all night.

If you are in a position where you can continue to make your regular payments, but you simply need to stall for some time to gather your past-due amount ...
I am not advocating this trick, but I have seen it done before ...

Go into bankruptcy court and file a pro se 13 case, costs about $300.00. Once you file, it will automatically stop the foreclosure as the case will be pending.

You may be correct that you can't succesfully complete another 13 since you are 3 years out of your last one -- but you don't need to complete it, you just want to buy some time. Once you file, it will take the trustee about 2-3 months to realize you were just out of a bankruptcy. He then needs to file his objections to your case and he will motion the court to dismiss the bankruptcy. By the time a judge dismisses your cases, it might be 3-4 months after you file. For that 3-4 months while the case is pending, your mortgage is under a stay of collection from initiating any foreclosures; and by the time it gets dismissed, hopefully you've saved up enough to bring your mortgage current.

My company is a member of a trade assocation that looks out for finance companies. The assoc holds meetings twice a year or so, and they usually discuss new laws and how it impacts our business. When the new BK laws first came out in Oct 05, this was the main topic of our meeting.

As I understand, the first BK filing goes through with all normal procedure, and there is a regular stay of collection. If the first BK-13 gets dismissed, and the debtor files a subsequent (second) BK-13, then there is only a 30-day stay of collection until the court can review the case. If the court believes the case has merit, it can order a full stay of collection; if not, the case will be dismissed. If the debtor files a 3rd BK-13, then there is no stay of collection until a court orders such.

I used the HR block free file for fed taxes. It was easy, as I recall it being easier to use than turbo tax. I seem to remember being asked to pay a few bucks for "help" descriptions of certain questions/deductions...Plus I know for a fact that turbo tax's parent company lobbied very hard to kill California's own e-file system. I hate when companies try to impead progress...while ripping off the consumer.

My husband just called and tole me we were getting a little over $1500 back from federal, so looks like the mortgage company will get getting all of that and should be in our bank account by the 15th if not sooner. We are getting some back from state, but some of it will be taken from us due to oweing something else, so we might see $200 of that. That will go into our savings account. Not as much as I thought, but better than in years past and at least is should help us get caught up this month. That will allow us to send a payment on the 16th and one on the 30th and then pay Aprils pretty much on time. UGH!!!!!!!!! Too much stress!!!!! Swoody, know that I am praying that things will work out for you too!!!

Oh, on an up note, my husband's work is picking up so they will start working 10 to 12 hour days, so some overtime, at least for a while and that will help too! I have felt like we have hit the bottom of the barrel and now, hopefully, we can start working our way back up.

Me too! He has been so frustrated. Some nights he didn't even get 8 hours and that hurt. The good thing about where he works is that anything over 8 hours per day is overtime, not anything over 40 hr per week like the company I work for. I just said a great big thank you to the guy above and a thank you to everyone for letting me rant and cry a little bit. It is nice not feeling so alone when things happen and know that one has someplace to turn.

As we go through these things together 2nd band we have all struggled, some of us still are, we can struggle together. I feel so close to some people here and genuinely worry about them. I have worried about you and your family, I am worried about swoody. Strange how complete strangers can take each others hands and get through a terrible time. Know that you are in my thoughts each day, and I send positive vibes your way, hoping something good will happen, hang in there girl. We will all be fine together!

I'm glad to hear that your tax return will be able to help you catch up on your mortgage. It must be a big relief for you and your husband. I can relate because my husband and I went through something like that last year. We completed a long forebearance agreement in December and then the mortgage company claimed we were behind again. They sent a current payment back and it was very frustrating. I talked to their lawyer's office on several occassions to get things straightened out. We were not at fault and it came back to bite the mortgage company in the butt. It was frustrating that we had to deal with it this past time though. Keep us updated on your progress.

Hi guys. i have a quick question for anyone who has been in this boat before.I talked to our mortgage company, and they are tryng to work out a forberance agreement with us. The only thingis, is that it will more than double out payment for 5 months. My question is, would it be better to do a forberance agrement, and pay more for five months, or should we consider filing chapter 13. It is going to be very tight for 5 months. We are talking 1700. a month just for our house. Any suggestions or advice would be appreciated.

2nband, we were in the same situation back in November. When you received the "Loss Mitigation Packet" this includes an income and expense sheet make sure you put down every last penny you spend down, they are going to ask for w2 and income taxes for 2 yrs., verification of income. make sure that you ask for a "Loan Modification" (means they will put the delinquent amount at the end of the loan and your loan then will be exteded sample if you were to finish paying for the house in 2020 simply it will extend perhaps till 2021 but this will bring you current. Don't ask for a forbearance or repayment plan because there's no way it can be done for the monthky payment will almost double.I been there.

With the tax return and another payment this month, we should be caught up for Feb and Mar. Had to deal with a real butt head last night who was very unpleasant and more or less put us down for using pdls etc. I just hope that we can get things back on track and refinance the house, (once our credit gets better) and get out from underneath these people! They can call up to 10 times a day and sometimes you can talk to someone and with in an hour, get another call from them. The dip I talked to last night told me that they did not have to read previous notes, etc. He just totally got on my last nerve!

We usually let the phone ring when we see their number on the caller ID. They hardly ever leave a message. One day, they called like 3 times within a 20 minute span. That was quite a while ago. They told me they were on a "dialer" that places the calls, and I asked if a person was already spoken to, why couldn't they take the number out of the loop for a while, and was told they didn't know but it didn't matter anyway when someone owes a past due. I will guarantee you when I get home tonight there will be at least 2 to 3 calls from them and I am sure there will be a couple more tonight to. My kids will turn the phone on and off when they see them calling. I don't mind talking to them once in a while, heck could live with once a week, but they don't work that way. I even cringe at their commercials, (it is Washington Mutual). One of my neighbors had them and said they were a pain too. He got behine one month and they called him starting before 8:00 AM and would call as late as 9:00 PM. He works nights and sleeps during the day and he said he had a big go round with them over them calling him while he was sleeping.

We had to fight them one time because we had sent some money orders to make a payment to them because we were out of checks and they lost one of our money orders and then kept telling us they could not take partial payments and we were behind and such (and that was within the first 3 months of us being in the house). We had the copy of the money order and gave them the money order number, how much it was for and even overnighted them a copy of what we sent. 1 week later the money order was found. Now it was in the same envelope as the first money order! How they lost it, I have no idea, but I wrote a bit of a nasty letter to the accounts receivable manager and within a couple days the money order showed up, but they did not credit us any late fees and the payment was not late! It has been a nightmare with them.

Not sure if this helps or not, but I used to work for a Foreclosure Attorney who handled the Mortgage companies foreclosures. Anyways, you have up to the time of the sale to pay an deliquencies. So if you owed 1,000 you could pay the 1,000 the day of the sale as long as you get it to them before the start time. Also, foreclosures usually take 6-7 months before sale is set.

Did get another call from them last night. There were 8 calls on my caller ID when I got got home! Talked to a female this time, don't remember her name right now but have it written down at home and she wanted me to go through the whole spill all over again. Being in a bad mood, I told her to read the notes from the the other night and she would have all her answers to her questions and that I was not repeating myself again and did not have the time because I was headed right back out the door. She told me that she did not have to read the notes and I had to give her the information again. I told her I knew she was doing her job, but I was headed out the door and she just needed to read the notes. As I was getting ready to hang up the phone she said "Deadbeat". Whether she was talking to me or mumbling to herself, I don't know, but them a$$' will be caught up at the end of the month!

Sward, thanks for that information. I didn't know how it worked as I am sure many others didn't. Appreciate it very much.

I just got caught up again this month, next month I should be fully back on track, hopefully. We both work and paid off a few bills last year, so we don't have much to worry about. Hubby does not know anything that goes on the finances, he lets me take care of all that. I don't tell him much of anything, it just causes stress and it is nothing that I can't handle. We will be fine here in another month. SPRING AHEAD in better financial shape!
