Hello and I want to begin by thanking everyone on this site for being so helpful. I read how many people's lives were helped from everyday people giving advise. Currently I have pdls from
Paydayok.com
soniccash.com
advanced america
Geneva Roth
tendollarpaydayloan.com (shows up MTE Financial on ACH)
cashnetUSA.com

I am pleading, does anyone know if any of these are illegal in PA, or if there is anything I can do. The longest payday loan I have had is with paydayok for almost 3 years! I know, like an idiot I would take out a loan, pay it back after a year, take out another one a couple of months later and each time for more money and longer. My most recent loan from 03/05 and is still open now and I paid so far $2,410.66. $500 with 24% Max PA interst yearly is $620. I am owed $1,790.66 and I don't know where to begin in getting my account paid in full, but a refund as well.
Does anyone have any experience with paydayok or any of the other one listed? I woul dlike to start small with paydayok and Advanced America and then tackle the other ones. These crooks have got to stop!


I am from Pa and have been dealing with some these companies. I have a web blog on it, go to blog hunt and look up thehub.yesdebtfree.org , you can access template letter there as well as the law for Pa. You should be able to get a refund from paydayok, I have a template there for that also. check your pm (private messege) I will connect with you more there on Pa. In the meantime go to the page and use the letters there, read the tips on templates, it will be helpful. goodluck

Small loan caps do not apply to pdl's, per the PA Banking Dept. Since there are no laws regarding pdl's in PA, as long as a pdl is legally licensed somewhere else, they can charge and do what they want to. It sucks, and I know it isn't the answer you want.

You can still try. Some pdl's aren't licensed anywhere.

If I was you I would pay off the store front payday loans first because they are the ones that are legal in your state. I have dealt with Advance America. But I live in WI. Both my hubby and I each had a loan through them and they totaled almost $2000 and they accepted a $25 per week payment on each. But I had to default on both of them first before they would make any arrangements. I also called them and let them know my situation and told them what I was going to do before it happened.

Thanks everyone for the tips. I DO want to tackle the storefront 1st because that is the most expensive one. With the felp of fedup, I sent a letter to paydayok asking for my account to be paid in full along with a refund of excess over $1700. I've been paying them on and off for 4 years and i had no hope until I cam here

My information comes from the PA Division of Banking, and from talking to state reps from PA. Because PA doesn't have any laws regarding pdl's from other states, there is not interest rate cap.

When I talked to them, they said that it would be nice if the small loan rate cap applied, but that isn't the case. It is a very gray area since there isn't any legislation pertaining to it.

I'm not saying it's not possible to get a refund. I've had a pdl that all I asked was why I couldn't pay by money order and they responded with "we will just mark you paid in full".

Some pdl's are so worried about bad publicity and just don't want to deal with problem customers. They will give in to you. Others will fight you to the tooth even when you have every right to a refund. It's hit and miss. Nothing is guaranteed.

I'm interested to know who got a refund and from who?

I just got a phone call from arrowhead that my account will be marked paid in full, I used the Pa law and it worked. I also filed a complaint with the attorney generals office. It was the call from the attorney generals office and the letter quoting that law that me them come to this decision. It has worked with a few. I would definately be going after paydayok for a refund that is just ridiculous how they take advantage of people.

absolutly. And thats good info to know goudah. I gave them 24 hours using teh usual template, so I should hear something today. I will post their response. It would be nice for them to mark me paid in full, but I will fight to the end for a refund. I've been with them since 03' and the $1700 I'm asking for is not even half of what I should get in finance charges.

update: I have not heard from Paydayok yet. I checked my account and it still shows what it did before. I reissued another e-mail last night infirmung them that I had yet to receive a response from my original letter enclosed, etc., etc. I'll see if they respond later today. I've heard they are good at responding to people. I don't know what to do next if they don't let me know something.

Hate that loophole, I did have some success with filing a complaint with the attorney generals office. Arrowhead said I still owed them $510, after I filed the complaint with the attorney generals office and informed them of that, they graciously back down, marked my account paid in full as long as I withdrew my complaint against them. It may have been bribery on their part, but I have it in writing via fax, account paid in full. Thats all I wanted.

I would not settle for a paid in full, I would demand a refund, that is nuts how much they have collected off you on that small loan.
Don't be coercive (sp) but I would inform them that you intend to file a complaint about this and you should. Don't make it sound like a threat or a trade off to get what you want. goudah, had some posting on fine lines of being illegal, can't remember exactly, Goudah, maybe you could advise here. They should be reported. They may offer to bribe you into not doing it. I would tell them that I wanted a refund.

Thanks Goudah....I just recieved great news from Paydayok. Below is a copy, they say they will forgive my loan and offer a refund of $500. Praise God. I think I'll reply after the weekend, but I wanted to get an opinion from you guys. I must have paid them over $4,000 all these years. Should I just take the $500 or should i go for the $1750 like I originally requested? If so, what should I reply with? I couldn't have done it without fedup and everyone else's help on here!!

That is great news, 1 down huh, you are well on your way.
You have a tough choice, $500 is better than nothing. I would try one more time to negotiate some more out of them, but then you run the risk of them withdrawing that refund. It is up to you. Take the $500 and a valuable lesson learned, or try to get more. Don't really know what to tell, seems unfair, but like I said, better than nothing. Just make sure you get something in writing that the account is paid in full.

How are you coming on the other ones, need help, yell, we are here.

You are making great progress, hang in there, you will be done in no time!

I am curious to know how the other ones are going, I am certain with the help of this forum and as long as you have been paying you should be rid of all these like "RIGHT NOW", Can you list what you borrowed from each of the companies, when you borrowed and how much you have paid back. You have taken the first step and gotten great results, don't stop here, you have the debt cc fire in your veins now. LOL, any way if you list the above information, some one will come along and help you. I will be watching for your post.

You can tell them that you have filed a complaint, but do not say that you are thinking of it, or anything like that. Pretty much just don't make it sound like if they give you what you want you won't file the complaint. Just tell them you are planning on it, and put at line at the bottom of the letter that says you are sending a copy of the letter to the AG's office. These complaints are very important. It encourages your state to fix the laws, so this doesn't happen to a bunch of other people.

But if they are legally licensed in another state, then they may not be breaking the law (PA's stupid loophole). . . . What you need to do is check on the licensing status of the pdl, then look at the state laws on pdls for that state. That will tell you what kind of refund you are due.

I filed a complaint about all of them on the Attorney generals website. I figured it was not extorsion if I filed the complaint and then reported if I had a good outcome, right? Like with arrowhead, got a paid in full, the did mention the complaint with the attorney generals office, they ask me to withdraw it. I told them myself in a letter I was filing it. They never moved for my letters before, until the Attorney Generals office got a hold of them!

Hey guys I was out of town and I appreciate everyone's suggestions. 1st off I agree with everyone saying to use that money to pay off another loan. That was my total intent. My storefront is $623 to pay off, problem is I have to go in tommorrow and pay the $150 service fee which is required each time you go in and don't pay off your loan. What I'll do is by the time I get whatever from paydayok (couple of weeks) I will then go in and pay that off, then 2 down. Yipee. Anyways guys, I thought and thought and read everyone's suggestions. Fedup, I think I'll write them on more time and see what they say. I run that risk, but I don't want to not give it a try and then later wonder "what if". I'll keep all updated and I couldn't have done it without the help of everyone here. I'll be back on later and list how much I owe with whom. Thanks.

Fedup - You are fine. It only could be considered extortion if you tell the pdl that if they don't give you the outcome that you want you will file a complaint. You can tell them you filed, that's not a problem at all. In fact, everyone needs to file complaints against these pdl's. It's the only way that the laws will get changed.

i dont know where to turn for help i can not pay these loans back. with the interst i have to pay just to roll them over, i owe paydayok 500. and i have already payed them double that in interst. did stop payment to credit protection depot did a revocation of ach at bank, now cpd keeps calling at work called them told them to stop calling me at work, they told me i had to send them a fax stating this i did see if they stop. don't know if i should sent revocation of ach for all my other ones. is there anyone from pa that can help.don't know what to do behind 2 months in rent , elec, gas.

I am dealing with advance america, hate that participation fee crap, anyway, it stopped as soon as I defaulted on the loan. I made payment arrangements with them. 2 payments of $250 each, will cashnetusa took all their money out in one pop on friday, so I did not have. Advance america let me put the 2nd payment off for another two weeks, I was in shock how nice they were about it. I thought to myself, "are they violating something"

goudah it is advanced america and the interst seems low, but if you don't pay it all off in 30 days they charge you a $150 loan participation fee so the minium you pay if $174.68 and it doesn not go toward the principle. I know what you mean fedup. I want to def want to get rid of them quick. My cashnet USA full amount is due in 2 weeks. Don't know what I'm going to do there. We'll see.

I did call the banking department, they did sue advance america, they are waiting on a judge to make a decision. I don't see advance america being around long, just a matter of time. If all the internet based pdls without that crazy fee dont knock them out then surely the pa department of banking will.

Hey CFrancis, did you call cashnetusa and work out payment arrangements, they will cut it into four payments for you. I did this, just needed to buy time to get some others out of the way. The only reason they took the full amount out of my account was I defaulted in the payment arrangement. So if you are not going to have the money call them as soon as possible and let them know. If it bounces, at least their stupid fee stops and all money starts coming off your balance. goodluck

Fedup...I didn't know that. Thats wonderful news to hear. i'll call them right away.

Going away this weekend again friends. My husband's grandmother passeed away. I'll be on and off this afternoon, but I may not be back until Monday. I'll let everyone know if paydayok says anything about my response.

Its good to know advanced america is getting what comes to them. If they sue that means anyone who borrowed money from them can put into a class action law suit. That'd be nice to get something back from them crooks too eventually, even if it is split with thousands of other people.
