Law office of joe pezzuto - need advice on this collection agency?

I was told they would not do payments, I was asked what I do and how much I make. I told them I could have the money in 6 weeks. They told me I had 24 hours to call back and tell them how I was getting the money and make arangements to do a check over the phone for the whole amount and he could give me 3 weeks before he sent it through.
I don't like doing checks over the phone and I don't feel I should have to tell them how I am getting the money just that I have it and when i can get it to them.
When i call them back I plan on asking them to send me something in writing and I will send them a certified check by the end of the month (3 weeks).
What do I do if they want to strong arm me by saying they will have to start leagal procedings or something like that. Do they have the right to ask me how I plan on getting the money? I need advice on what my rights are in this situation and how to handel them. I am more than happy to find away to pay my debt.

The conversation I had today with your “office manager” was very frustrating I was flat out told that needed to come up with money somehow and that I should pay my bills. VERY UNPROFESSIONAL. I tried to tell him that I didn’t have the money and he said that I should have read the contract before I used the credit card and that I was saying that I was refusing to pay the debt I NEVER said that I said that I said that I didn’t have the money and he proceeded to tell me to find it I am willing to make payment arrangements but it has to be reasonable I know that I am not that far behind in my bill and I can do 60.00 a month until it is paid off but that is all that I can afford He didn’t even give me that option just that I needed to find the money .. and that if I didn’t pay the debt off that legal action will be taken I advised that I didn’t think that they could” best buy” couldn’t do that he told me I didn’t know what I was talking about. and proceeded to callme a dead beat. i also found this on a forum that i was reading this came from someone in that law firm 'THIS INFORMAITON IS FOR ALLOF YOU DUMBA**CRIMINAL LOW LIFE DEAD BEATS THAT RUN UP HUGE CHARGES ON YUR CREDIT CARDS, THEN DONT WANT TO BE RESPONSIBLE FOR PAYING BACK WHT YOU OWE.

He then asked me for take out a loan use credit cards or get a line of credit ... how rude! If i had the money in a lup sum i wouldnt be in this position, i asked him what are the options for a payment plan, he says no you need to pay it in full. i was so stresed out over it, he lied and said they dont do payment plans which i know is a lie. they saw a big debt and thought let's bully her to paying it out. mind you i just got out of college. so i thought of filing chapter 13 or debt consolidation. In the end the best thing for me to do was debt settlement of all my debts, he told me i couldnt do that and doesnt deal with "them". He's right! when i was trying to give the information for the debt settlement agency she couldnt find " the law office of Joe Pezutto. It's only when i put in the creditors address it came up. he then proceeded to say that he was tired of going back and forth with me and that he was going to tell the creditor that I RUFUSED TO PAY IT. can he even do that when i didnt even say that?! he didnt give me a chance to speak and he just hung up on me twice when i called back! i then called my debt settlement advisor and she informed me that i did my part i let him know what i was doing a, adn she told me he was unproffesional and not to worry myself because i did my part as a debtor.

I have never recieved any correspondence thru the mail from them and I asked them for their address. They asked me why I needed that and I told them because I need to send them a debt verification letter. At that point they started throwing well if you send that to us then we can't give you a deal on your debt. So I played their game and I said ok What is the deal. they said we can settle for 12. I said. How about 8? And the "real nice" fella on the phone said. Ok but I need to know tomorrow if you have the money and "I'll go to bat for you" Classic! So they told me if I sent a letter they were going to come after me for all of the 20,000. They don't want people to send them a Verification letter asking for signed contracts because they know the lending company has sold this debt to them and has washed their hands of it. And that 90 to 95 % of the time they cannot get the proper validation paperwork to continue to persue this case. If they cannot get the paperwork then they will have to dump this to another colletion agency and when that happens the chances of them getting the proper paperwork goes down even more. So don't be scared or intimidated use it to your advantage. But whatever you do If you make a deal with them get it in writing before any money is exchanged. Tell them you want the debt to show on your credit report as paid in full and as promised, You want no other collections against you EVER for this debt and that this debt is 100% dissolved.
Collection agencies
regardless of who they are if they are attempting to collect a debt I would not give them information. The best thing you can do is. Tell them yes you are the person then tell them to mail you a copy of the debt you owe. If they ask for your address refuse saying they should have it. Do not give them any information for verification just tell them to mail it to you. You may have to pay a little for this service but it is guaranteed to work. look up repair my credit now and let them do the work for you. I had several things on my credit that were not mine and called them. Not only did they get these items removed from my credit but they stopped the harrassing calls as well. This is not a ploy from them to get you to use their service I actually used them. If you don't use them find another one but becareful because their are scams out there. I had about 18,000 dollars in medical bills that were supposed to be paid by workmans comp but it was not filed right. It cost me 1600 dollars that I had to pay out but they removed all 26 negative items from my report and stopped the calls. :D

My question is - my original creditor was Providian - then it went to collections, I believe it's CACH, LLC now and then it went to the Law Offices of Brian K. Levy which then turned into the Law Offices of Joe Pezzuto.
I get this letter that looks like some sort of legal document that's from a lawyer or the courts or something making it look like I'm in a lawsuit.
Can this "law office" collect a debt for another collection agency who was not the creditor??

If this is a legit debt and company, they do have a right to start legal if they wish, but keep in mind that they must serve you and go to court before they can actually start taking money from you. In most cases most the questions asked are to make sure you are not biting more then you can chew on your promise. Most agencies are aggresive but not really illegal there is a fine line bwtween the two. In closing I doubt anything will be done if you give the info on where is coming from you actually pay at that time good luck!

They WILL LIE to you and tell you they ARE a lawyer, they are a collection agency that is part of a law firm. DO NOT GIVE THEM ACCOUNT INFORMATION! Have them send you proof that they have bought the debt you owe FIRST. Then make arrangements. Send them a certified check, give NO one your account information. They will tell you that they are going to take you to court if you don't pay in a few days, which they may and IF they do hold legal debt against you they CAN but it wouldn't help them if you can pay them within a few months as it takes a month to even GOTO court and then court has to make you pay! By that time they could have gotten the money directly from you in the time period you have it. DON'T LET THEM BULLY YOU. They WILL talk down to you, tell you YOU wanted to skip out on the debt etc. These are people who get paid to bully you, stand your ground and read as much on your legal rights if possible. If you have any issues with them, contact the BBB as they already have TON'S of files on this "law office."

I have worked in collections for 18 years and have seen many people sued. You should not give advise if you do not know what you are talking about! If you want to know what happen to people who do not pay their bills talk to an attorney.

These Joe Pezzuto morons kept calling about my debt after USB sold it to them. They harassed me any way they could and made fun of me, saying I had 10 credit card debts when it was only two. Anyway they also advised crap like I should ask my friends or family to get a loan out for me to pay my debt.. what kind of illegal advice is that? I wanted to arrange monthly payments but they don't do that and they wanted me to pull 8k out of my ass in 30 days and put it on a silver platter for them. I didn't have a job and I would have been homeless if not for my family.
They use the "good cop/bad cop" tactic where one guy talks like "I'm on your side I just want to help you" then if you don't agree to give them the money they call the "manager" who is like "bitch, give me the f***ing money in 24 hours or I sue your ass" I was advised to not give them any information. They sent me letters about the debt. They threatened me that they would turn my debt to a lawyer saying they have some kind of a deadline to make arrangements and if I didn't then they would have to assume that I refuse to pay the debt and pursue legal actions (whatever that means). I own NOTHING except for my car that is barely worth 2k so I wasn't worried about them coming after me. The last letter they sent me was for a settlement... but they called me EVERY SINGLE DAY including weekends, sometimes twice a day.. then I got sick of them and didn't answer the phone when they called.. and well they SURPRISINGLY stopped calling after a while. My advice is to do the same and just DON'T ANSWER THEIR CALLS.

Second of all, there are real attorneys that work in these offices, and generate legal proceedings against people who do not pay their debts. Why? Because, again, it is illegal to borrow money and not pay it back.
Third of all, when YOU open any line of credit, be that with a bank, or a credit card company, you sign an agreement that allows for the addtion of default interest if you stop making paymnets. Why is it that people who get themselves into these postions act as if they have done nothing wrong, and the people who are collecting this DEBT are the creeps? If you borrowed your neighbor money on the condition he/she would repay it in a timely manner, and they didn't, would you take them to small claims court? Yes, if the amount was significant to you.
Now, think. Lets say there are a thousand people that do that every month to creditors. Exactly what do you think would happen to the lending institutions of America if they had no recourse to recover the money they borrowed under good faith terms, and some j$#k decided they didn't have to repay that?
People do fall on hard times. People also get over them, and they need to take responsibilty for their actions. Spending money that was not theirs to spend, and not paying that back is extremely irresponsible. And you call people who try and collect this money bottomfeeders? Seems to me you have it backwards.

We do not advocate that people should not pay what they owe. However, when people try to make arrangements, and they are told "you have ten debts with us" when they really do not, THAT is what is illegal. You do not help your position when you ignore the things that bottom feeders like this one do that break the law, I can tell you that right now. The moment you try to pretend that these companies are doing no wrong, you just blew all credibility.

Then go tell those "real attorneys" to go back to law school, because the tactics those "real attorneys" use to try to contact people, threaten them, scare them into paying debts, often while refusing to validate--ILLEGAL--and often without even making sure that they have the exact person that actually owes the debt, all of that isnt legal in any state in the land, chief. Kinda funny that a quick check of Justia shows more than two dozen lawsuits within the last couple years against Pezzuto, all for FDCPA violations....yet here you are, blaming others for not wanting to work with them?

We see our share of people that just want to get away from their financial past, and those people need to realize that they do need to pay their bills. I do not make any excuse for them--it is their issue and they do need to address it. HOWEVER, you look like a fool stepping up to try to pretend that these bottom feeders are legit. In fact, if you look through the posts here, you will see many where people tried to work with the debt collector. You will see where people were threatened illegally, lied to, tricked into agreeing to pay a debt. So, lets answer your question--if my neighbor owed me money, here's what I WOULD NOT DO:
--tell him he's been sued when he has not been
--illegally call his relatives/friends/employer after I already have located him
--threaten him that he will be arrested for not paying the debt
--insult him, his family, his children, his dog, where he lives, or whatever else
--curse him out and demand that he submit to me
--send him falsified documents so that he thinks he's been sued
--threaten to have his children taken away, threaten to take his house for a $300 debt, etc etc
--pretend to be a police officer/detective/lawyer/officer of the court when I am not one
etc etc etc. If you dont get the point from that, then stop posting and get back on your phones slacker. And I hope and pray that the next number that your autodialer connects you with is mine...:cool:

They are only kidding when they pretend to be someone else, and post ridiculous crap on places like 800notes, calling the owner of that site a "child abuser" and worse over a made-up story. Chuck, the big shot at that "law office", tried to get comments about Pezzuto removed from that site, and the site's policy is that the comments people post will not be taken down. This is entirely legal. It's called "freedom of speech", and I think I remember seeing something about it in some old rag known as the Constitution....
Anyhoo, when Chuck's pleas to remove the posts failed, he then asked about buying her website. Again, that failed. So then someone from Pezzuto started posting over there. Making it up as they went. The posts were traced back to the same place that Chuck's messages came from.....and now, you come in here talking about "taking responsibility"???

This is the WORST advice you can give someone. If the debt is legitimate, then YOU PAY IT. What kind of moron actually tells people to wait until you get sued? What for--so you can pay MORE? Legal fees, court costs, and extra interest can REALLY play havoc with the amount you owe!

7/25/2012 - These folks have been calling relentlessly for a few months now in regards to a debt I owe to Wells Fargo Financial. I am not disputing the debt and I do intend to pay it. But after reading all of the horrible comments from folks on here, I'm just wondering if there is a nicer solution than dealing with this company. I definitely can't pay in one lump sum like they threaten to do.
As of last night (7/24) we actually had someone show up at our door with papers from the Law Office of Joe Pezzuto stating "Enclosed herin and served upon you please find Summons, Complaint and Acknowledgment."
The papers attached state that the plaintiff is CACH, LLC with whom I have never had contact. It also states that the plaintiff has started a lawsuit against me and I must respond even though it may not yet be filed with the Court and there may be no court fule number on this summons.
Is this for real??? Or is this a scare tactic??? I plan to write them to ask for verification of my debt as been mentioned in this forum in the past.
Has anyone had this happen and should I be looking at a lawyer???

first go to your court clerk's website.first type in your name as the defendent.i almost guarantee there is no case.look at skydiver's post number 69.he cites where this scumbag collector sends phony docs to make one think they were sued when they are not.confirm either way with your court clerk.if no case i would look into suing pezzuto a good one.if by some miracle there is a case by all means respond,but i doubt there is one.
