What if they are calling from overseas? Do you know of any recourse then? I know Route 66 is headquartered in the UK, but they do have call centers in NY and NV . . . . . I'm not sure exactly from which office the calls to me came from, and I don't know if there's any way to tell.

Hi guys! Okay I have emailed and faxed the letters to all three places, now my letters are all ready for me to go to the post office and send them out registered in the morning. Working nights makes it kinda hard to do anything else but work and go home and sleep. By the time I get off at 7am then drive 40 min. home I'm too tired to think of anything but sleep. But the letters are all addressed and I'll be going straight to the post office in the morning. I do know one of my IPDL is based in Costa Rica (mypaydayloan aka zarvad) but they do have offices here in the US in Salt Lake City. And I'm sending a letter to each of those locations. While I'm here, let's suppose these people won't go along with what I'm asking with the repayment plan? Then what do I do? Or maybe I should just wait and see what happens and don't get too far ahead of myself? Hope everyone has had and is having a good day. I'm around just having to actually do my job in between reading the posts. Imagine, coming to work and having to do something to get paid? Kidding, can you tell I'm feeling a little better about things?

I'm still like a lost puppy with all this, as long as you point me in the right direction I can usually follow the lead. I just get confused as to what direction I needed to be headed in.

Well I just checked my email, and had a received an email back from Sonic Cash, and was told that my account was already paid in full before I sent the email to them. The problem with that is, they were one of the ACH withdraws that I had the bank reverse the charges on. The had taken $240.00 out of me account along with payday-loan-yes for $155.00, and I had both of those charges reversed. So what's up with that? Could it be that my bank hasn't tried to contact them to get the money back or is my bank eating the cost? Because surely, if my bank were going to go after them for the money they would know about it by now wouldn't they?

I have no idea how long it takes banks to do those things, but I do know that most of them investigate unauthorized charges and come back with the answer in about 5 business days. But the pdl would've been contacted during that time the provide their proof.
I would keep the letter. If they are saying you are paid in full, then hold them to it!
And as long as you ask the questions, we here can try to get you the best answers . . . . Previously you'd asked what to do if they don't agree . . . . Trish said that you should just send them what you suggested for the payment anyways. I doubt they won't take it. And you know that they can't do anything to collect on it, unless they send it to a registered collection agency. Or you could also keep sending them letters until you can get them to agree to reasonable payment arrangements. But we can go more into detail about that stuff when you get there.

Okay there are 3 PDL's so I wrote all 3 letters revoking my authorization to withdraw from the acct. Now mypaydayloan (zarvad), didn't on the schedule day but the day after and of course the bank returned it, now the second was payday-loan-yes (cashnet/global) who deducted twice, 1 for 105.00(the fee)and 2 for 50.00 (the principal) anyway I got an email Wed (march 14) from that tim atkins at payday-loan-yes that said they were experiencing a promblem with my checking account and to contact him. So apparently the bank got the money or stopped it before it went all the way through. But Sonic Cash says I'm paid in full, that's odd that the bank has been able to do something with one of the transfers and not the other. And when it comes down to it I'm just kinda scared the bank might come back to me, because it's my word against the PDL's, especially Sonic Cash because they didn't respond to my email revoking authorization so all they have to do is say they didn't get an email from me. But I told the lady at the bank that, and also I thought it odd they didn't even ask to see the email I sent them or make a copy of it, nothing. What do you think am I just worried and trying to make trouble for myself when there is none? I am a most accomplished worrier!

All banks have different policies on how they deal with disputed transactions. So far, your bank has worked with you and helped you get things fixed. That is great. I wouldn't worry about it unless they come back and say there' s a problem.
Another thing you do have on your side is this board. You can do a search for cashnet500/payday loan yes and see how many times they have fraudualantly deducted money from others account. You can close an account to prevent fraud. That bank could see that you were doing your homework and are tyring to prevent fraudulant transactions on your account. The revoked authorization could be a moot point.

You asked earlier in this topic about Us laws and overseas companies. If they have a office anywhere in Us or Us territories,they must comply with Us law.If they are 100% overseas,it gets a bit more difficult to pin down. In basic business models,if you enter into a contract with someone in their home country,their laws would apply unless it would specify in contract to use country of company. Most countries have provisions that if contract provisions would violate their laws,it is not a valid contract. To get information on international business treaties/provisions,we would start with the state dept and commerce dept of US.
For example,
You entered into contract with a payday loan company.Later you found out that your state prohibited this loan and their contract violated the federal Truth in Lending act. That contract is no longer a valid contract in the eyes of the law.To get legal compliance would be a federal matter in Us court.

I have been reading some posts on wage assignments, and from what I gather they aren't legal if they aren't signed in person. Is that correct? I know when your check is going to be garnished your notified by the court and usually the employer also sends a letter letting you know that they have a court order for garnishment, so in a wage assignment would the employer let a person know that they had received a wage assignment against your paycheck? I would think that they would because that would give a person time to revoke it before the actual "deed" was done and a person's check went to someone else. I was just wondering that for someone that might not have thought about if they had "signed" an assignment over the internet and therefore didn't think about sending a letter revoking it to their payroll dept. It's alot easier to stop it from happening than trying to recover it before it does happen.

Technically, since wage assignments are voluntary, your HR dept isn't required to inform you, because they assume that you agreed to it and know about it. There's an MOD here that's an HR person, she may see this post and elaborate.
Also, the laws do say that a wage assignment has to be signed in person, and there are a few other requirements. I don't think that it's followed at all. If someone's wages were assigned, they would have to take the place to court and claim that since the assignment wasn't signed in person that it was invalid. But by then you'd already be out money, and you may need a lawyer, which costs even more.
That's why it's a good idea to always revoke. Even if you don't think you signed one. There are also a lot of states that don't allow wage assignments for anything but child support. So also check your state laws on that.
It may be that by the time your company receives the wage assignment it may be too late to revoke it. I'm not sure how that works, but I thought you had to revoke it before it went into effect. But since it is "voluntary" maybe you can revoke it at any time.
When you send out a letter revoking the wage assignment, you always need to save copies. That way you can prove that the assignment was revoked.

I couldn't remember sigining any, but not even thinking I hadn't printed out the contract so I wasn't sure, so I revoked any that I might have agreed to, and sent a copy to the payroll dept. Better safe than sorry. Still havent' heard anything from the IPDL's, figured I would give them until Friday, and start mailing again. Then if I don't hear anything I'll just start sending the money orders to the address I have. Registered mail, of course.

I didn't think it was going to happen, but I gotta say everyone told me to stick to my guns and don't get down on myself and I could accomplish it. And ya'll were right. So MyPaydayLoan (Zarvad) has closed my account, Sonic Cash sent me an email and said I was paid in full, which I really don't understand that at all, but I saved the email they sent me telling me that. Now that just leaves PayDayLoanYes, which I haven't heard anything from. I did for the heck of it try to log into my account with Sonic Cash and it told me my account was on hold. Just wondering why it didn't say closed instead. Could they come back after they sent me that email saying I was PIF and try to get the money from me? Because if you remember from my first couple of posts they got the money from my account when it was forced open again after I had closed it. So I thought maybe when they said I was PIF it might have been before the my bank had contacted them when I reveresed the charges. Or since they sent me that letter of PIF would they have to honor that? Well anyway I'm not going to worry about that now, just going to be happy for a little bit, knowing that now I'm down to just dealing with one of those so-called Loan Companies. And yes I have to say it again and again, thank you everybody who has given me advice, helped me with my research on the laws in Arkansas or who just told me not to be hard on myself and let me know I wasn't alone. Ya'll are just GREAT!

As far as sonic goes, if they try to call you and say you still owe, I would tell them you have an email from them saying your account is paid in full.

As I read these true to lif stories I Find myself a victim too!! Oh My God how I wished I neve did this one thing lead to another, and now I am scared to death as to what may happen next. I live in Florida and I Fell that i am going to get srewed to the max. Can anyone tell me what I should do First Once I start to get these monkies off my back . The hits have already started, I wonder why these companies don't take the money that they are taking from people apply it to these accounts and call it a done deal , maybe they want have so many sad people and not return of people that really want to work with them and STOP being crooks. :(
